Four first time offenders in the criminal justice system were placed in Carbon County's Accelerated Rehabilitation Disposition (ARD) probation program on Tuesday by Judge Steven R. Serfass.

If a person successfully completes all conditions of the program the record is wiped clean. However, if they fail to complete it, or are revoked from it, the Commonwealth reserves the right to prosecute them on all pending charges. A person does not admit guilty in entering the program.Those placed were:Harry J. Connor II, 46, of Summit Hill, was placed for a year on a charge of driving under the influence (DUI). He was arrested on Nov. 1, 2010, on Fell St., in Summit Hill. He refused a test and will lose his license for a year for the refusal.Serfass ordered him to pay $450 for the cost of the program, get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment, render three hours of community service per month while in the program, and license suspended for 60 days.Kyle Joseph Fell, 22, of Allentown, was placed for a year on a charge of DUI. He was arrested on Sept. 29, 2010, along SR1003 in Kidder Township. Given a test, the result was .18BAC.He was ordered to pay $450 for the cost of the program, get a D&A evaluation, render three hours of community service per month while in the program, and license suspended for 60 days.Kurt Jones, 22, of Haveys Lake, was placed for two years on a charge of aggravated indecent assault. He was arrested by Kidder Township police for an incident on March 28, 2010, at Split Rock resort main lodge. He was charged with having inappropriate contact with a female in a hotel room. It was noted the victim agreed to the ARD placement.Serfass ordered he pay $500 for the cost of the program and render 35 hours of community service.Andraus Marcus, 35, of Blakeslee, was placed for a year on a bad checks charge. He was arrested by Summit Hill police on Feb. 21, 2009, for issuing a bad check for an apartment rental to Maxine Royer. The police report indicated three checks were involved but Marcus denies that claim.He was ordered to pay $500 for the cost of the program, render three hours of community service per month while in the program and make restitution in an amount to be determined by the adult probation office.Jeremy Scott Schmick, 26, of Summit Hill, was placed for a year on a charage of possession of drug paraphernalia. He was arrested on Nov. 13, 2001, in the 200 block of E. Water St., Lansford, during a vehicle stop.Serfass ordered he pay $350 for the cost of the program and render 15 hours of community service.Each defendant must also pay court costs and a $50 per month supervision fee while in the program.
