Charges dropped after victim recants story

A Jim Thorpe man, facing six counts of recklessly endangering another person, will have those charges dropped after the alleged victim recanted her story in Carbon County court Tuesday.

Dante Lewis Matos, 29, was charged for an incident on Aug. 30, 2016,in the 400 block of Center Avenue, when borough police responded to a 911 call of an assault incident. On scene Elaine Rodriguez told officers that Matos had assaulted and threatened her and her children. She repeated the claim at a preliminary hearing in January. Since his arrest and through all court proceedings, Matos said he never assaulted or threatened Rodriguez and her child and that her story was false. On Tuesday, Assistant District Attorney Brian Gazo, who is prosecuting the case against Matos, had Rodriguez in court. He told President Judge Roger N. Nanovic II that he investigated the claims by Matos and had spoken with Rodriguez. He said when he and police spoke to her, she admitted her original claims were not accurate.Gazo said he planned to charge her with false reports if she recanted the story in court. President Judge Roger N. Nanovic II then advised her of her constitutional right not to incriminate herself and that she did not have to answer any questions posed by Gazo. She said she would answer his questions. When Gazo asked her if her original story was true concerning Matos and the allegations of assault and threats, she said they were not and that she made them up.When asked by Gazo why she made up the story, Rodriguez said, "Out of jealousy."Gazo then said the district attorney's office would drop the pending charges against Matos and that he will have the Jim Thorpe police file charges against Rodriguez.
