Man who admitted using son in theft incident gets short jail term

A Carbon County man who admitted he used his 5-year-old son in the theft of a cellphone was sentenced to a short jail term on Monday in the county court.

Adam Spino, 30, of Lansford, was sentenced by Judge Joseph J. Matika to serve one to 12 months in prison on a charge of receiving stolen property.Spino was arrested by Palmerton police following an incident in the emergency room of the Palmerton hospital on June 17. Police charged that Spino took the cellphone of Patrick Trone while in the ER. Police also said Spino had his 5-year-old son take the phone, which was plugged into a wall outlet charging, and then gave it to him. Spino concealed the phone in a cloth and left the ER.At the time of his guilty plea Spino denied using his son to steal the phone, but he was reminded that in pleading guilty he accepts the facts contained in the police arrest report.Spino, who has a prior criminal record, told the court he was in 53 foster homes over his teenage life before he turned 18. He is currently on probation in Luzerne County.Matika said he heard his defense attorney Adam Weaver say he was remorseful for what he did, but added, "I didn't hear you say it." Spino then responded, "I'm profoundly sorry for what I did."Matika continued, "I feel you're downplaying your involvement. Police indicate you masterminded this theft."In addition to the jail term, Matika ordered Spino to render 50 hours of community service when released on parole, make restitution to the victim for $300, have no contact with the victim, pay court costs of about $1,000, and pay a $50 per month supervision fee while on parole.He will begin the jail term at 9 a.m. on Nov. 20.
