A Palmerton man has been charged with the alleged indecent assault of a minor.

According to the affidavit of probable cause filed by patrolman Elias Batihk of the Lehigh Township Police Department in the case against Kyra Beers:

At around 11:49 a.m. on Sept. 29, Northampton County Radio advised Batihk of a phone call request, and he called the caller and spoke with her on the phone.

The caller, who is now an adult, stated that she was molested and given dabs to smoke, which is a high concentrate of THC, when she was 13 years old.

The victim stated this occurred in July 2019 at a residence located in the 4500 block of Lehigh Drive.

Batihk asked the victim who the male was, and she was very hesitant to tell him the man’s name.

The victim did not tell Batihk the name and stated that she would contact police when she was ready and comfortable.

Batihk asked the victim if it was a family member, and she was hesitant and did not want to answer.

Batihk advised the victim this was nothing to be ashamed of and that he was there to help her.

Batihk encouraged the victim to come to the Lehigh Township Police Department headquarters. The victim came to the station at around 12:16 p.m. to speak with Batihk, and stated that in July 2019 she was molested by a man, she identified later in the interview as Beers.

The victim said she knew it occurred in July because Beers’ girlfriend was away on vacation in Wildwood, New Jersey, and that she remembered her exact clothing and hair styling the night of the sexual assault, as she was wearing white basketball shorts with strings attached on them.

The victim stated she came out of the residence and went outside and 30-year-old Beers had a fire going. The victim said she asked Beers if she could join him and he told her she could.

The victim said Beers was drinking a 12-pack of Angry Orchard, and that he gave her an Angry Orchard to drink and some dabs to smoke.

The victim said it was nighttime and she blacked out on the ground outside, and was in and out of consciousness but remembered Beers pulling down her shorts while she was on the ground.

The victim stated she pulled her shorts back up and told Beers “No,” and “Please stop.”

The victim was very visibly upset crying and emotional while telling Batihk.

Batihk asked the victim if she told anyone this after it happened, and she said she told her aunt and her mom. Her aunt got her a pregnancy test to take, but it came back negative.

The victim said she confronted Beers a week after it happened, and he denied it saying he would never do something like that, so she started doubting herself because she blacked out.

The victim said that at 17 years old she started having nightmares and relived the rape.

She said that on Oct. 29, 2024, she was helping Beers move firewood from a residence and that Beers was drinking Miller Lite and got drunk, at which time he admitted to her what he had done to her when she was 13.

The victim stated Beers cried and apologized to her for what he had done to her, and told her that he would have never done that if he was not drunk or high on that night.

The victim stated she wanted to see if Beers would go to counseling to see if they could work the trauma out, but every time she tries to speak with Beers about what happened that night, he ignores her and gets angry and doesn’t want to talk about it.

Beers faces charges of indecent assault and corruption of minors.

He is currently free in lieu of $50,000 unsecured bail, and scheduled to have a preliminary hearing on Aug. 10 before District Judge Robert A. Hawke in Walnutport.
