Man shot after pointing gun at police, charged

A Wilkes-Barre man who was shot by police after leading them on an eight-mile chase was arraigned on multiple charges Thursday night.

Deyvi Javiel Rincon, 23, was committed to the Carbon County Correctional Facility in Nesquehoning in lieu of $500,000 bail after being arraigned by District Judge Beth Dodson. He is charged with multiple felony counts of aggravated assault; simple assault, reckless endangerment, fleeing police and carrying a gun without a license.

According to court papers, Pocono Mountain Regional Police officers were conducting surveillance for a drug investigation in the area of Ahart’s Market on Route 940 in Tobyhanna Township, when they observed a Rincon’s vehicle and attempted a traffic stop.

Officers pursued Rincon westbound on Route 940 into Carbon County, where he pulled over near Route 534 in Kidder Township, and exited the vehicle brandishing a firearm, court papers said. Rincon disregarded commands to drop the weapon and approached them in a threatening manner, court papers said. Officers fired their weapons and struck Rincon, who was struck multiple times and ran a short distance before collapsing in the road, police said.

Rincon was secured, first aid administered and he was transported to Geisinger Wyoming Valley Medical Center in Plains Township, Luzerne County.

The gun, which was registered to Rincon, remained in the roadway, court papers said.

State police, who investigated and reviewed body camera footage, in which officers tell Rincon that he pointed a gun at them, and he apologized and told them that gun was empty, court papers said.

Rincon also told officers that there was a note in the vehicle that he wanted them to give to him mother, court papers said.

Pocono Mountain Regional Police Department said the officers involved have been placed on administrative leave.
