Carbon County court
An Andreas man was sentenced to a Carbon County prison term on Friday after previously pleading guilty to a retail theft charge.
He was one of eight defendant criminal cases to appear before Judge Joseph J. Matika.
Mahoning incident
Joseph Franz, 34, of Andreas, pleaded to one count of retail theft.
Franz was sentenced to serve one to 12 months in prison and ordered to render 50 hours of community service, supply a DNA sample, get a drug and alcohol evaluation and follow any recommendation for treatment and make restitution of $8.01 to Walmart.
He was arrested on Oct. 15, 2017, by Mahoning Township police.
Franz was given credit for eight days already served on the charge and began the jail term immediately. After he is finished serving the prison term he will be transferred to the Schuylkill County prison. He has outstanding warrants in that county on other charges.
DUI cases
The following cases involved charges of driving under the influence.
Alan James Arthofer, 32, of Bowmanstown, was placed in the Restrictive Conditions of Probation program (house arrest) for five years with the first 120 days on electronic monitoring. He was also ordered to pay a fine of $1,500, license suspended for 18 months, render 100 hours of community service and supply a DNA sample.
He arrested on Oct. 6, 2019, by state police at Lehighton along Route 895 at Bowmanstown, for DUI of a controlled substance.
Denny Antonio Castellaneta, 41, of Palmerton, was sentenced to serve six months probation, pay a fine of $300 and render 25 hours of community service.
He was arrested on June 14, 2020, by state police at Lehighton along Interchange Road, Franklin Township. He was found guilty of the charge by Matika following a bench trial.
Edward J. Hull Jr., 59, of Saylorsburg, was sentenced to serve 48 hours to six months in jail, pay a fine of $500, license suspended for a year and render 25 hours of community service.
He was arrested on Oct. 30, 2021, by state police at Lehighton along Station Street in Towamensing Township, after being involved in a crash.
He will begin serving the prison term at noon on July 22.
Pleas
Nathanial Al Cunningham, 26, of New Milford, Susquehanna County, pleaded to one count of DUI of a controlled substance. He was arrested on July 26, 2021, by state police at Hazleton.
Sentencing was deferred so he can obtain a drug and alcohol evaluation.
Allison L. Redline, 29, of Bushkill, pleaded to one count of DUI of alcohol. She was arrested on May 3, 2021, by state police at Hazleton.
Sentencing was deferred so she can apply for the house arrest program.
Trish L. Hargrave, 27, of Hughestown, Luzerne County, pleaded to one count of disorderly conduct, as a summary offense, with two counts of persistent disorderly conduct, misdemeanor 3s, dropped in a plea deal. She was arrested on Feb. 8, 2020, by Palmerton police in the 300 block of Lehigh Avenue, following a domestic dispute.
Matika imposed a fine of $150 and costs.
ARD placement
Jonathan Velazquez, 29, of Hazleton, was placed in the county’s Accelerated Rehabilitation Disposition probation program on a DUI of a controlled substance charge. He was arrested on Dec. 26, 2017, by Weatherly police along Main Street.
He was placed for a year and assessed $650 for the cost of the program and ordered to render 50 hours of community service and license suspended for 60 days.
If he successfully completes all conditions of the program his record will be wiped clean. However, if he fails to complete it or is revoked from it, then he would face trial on all pending charges. A person does not admit guilt in entering the program.
All defendants sentenced must also pay court costs of over $1,000 and a $50 per month supervision fee while on probation or parole.
