A Lehighton man was sentenced to a state prison term on Tuesday for driving under the influence.
Gerald Vincent Niehoff, 34, was sentenced by President Judge Roger N. Nanovic II to serve a total of nine to 18 months in a state correctional institution on the DUI charge and 90 days on a charge of driving under suspension-DUI related.The two terms run concurrently. The term will be followed by two years of state probation.Niehoff was arrested by state police at Lehighton on April 29 along Mahoning Street in Lehighton.Given a test, the result showed the presence of a controlled substance. It was not Niehoff's first DUI arrest for driving under the influence of drugs.Niehoff is also facing a state parole violation hearing.He was on state parole at the time of the incident. He told Nanovic he is facing about six months in state prison for the violation.He was also ordered to pay a fine of $3,000 on the DUI count and $1,000 on the suspension charge.His license was suspended for 18 more months on the DUI and 1 year more on the suspension charge.He was given credit for nine days spent in jail on the charges.
