Weatherly man pleads in gun shooting incident

A Weatherly man entered a guilty plea in Carbon County court on Thursday afternoon to charges stemming from a gun shooting incident, but did not plead to any gun-related charges.

James J. Pollin, 34, appeared before Judge Joseph J. Matika to plead to a felony 2 count of receiving stolen property and a misdemeanor two count of resisting arrest. In exchange for the plea, felony counts of possession of a firearm prohibited and firearms not to be carried without a license were dropped in a plea deal with the district attorney’s office.

On April 12, Weatherly police received a report of gunshots being fired in the 600 block of North Street. Police responded to the scene and spoke to a witness who claimed he heard about 10 shots being fired.

Through an investigation, Pollin became a suspect and police learned that a 9 mm handgun had been stolen from a relative of the suspect and used in the incident.

Pollin is currently an inmate in the county prison and his plea was entered via video conference.

Matika deferred sentencing and ordered the adult probation office to prepare a presentence investigation report.

Matika noted that under state sentencing guidelines, on the receiving charge, Pollin is facing a minimum sentence of somewhere between 15 and 21 months, which would put him in a state prison.

Sentencing was scheduled for 9 a.m. on Oct. 12.
