Penn Forest modifies short-term rental rules

The Penn Forest Township supervisors have modified their recently adopted rules on short-term rentals.

After residents said that the short-term rental ordinance allowed noise too late at night, the supervisors voted to change it.

“Unreasonable noise” will not be allowed after 10 p.m. Sunday-Thursday, and 11 p.m. on Fridays and Saturdays. The original ordinance allowed noise until midnight on weeknights and 2 a.m. on weekends.

There are exceptions for New Year’s Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving and Christmas Day, when the restrictions will still end at 2 a.m.

The definition of unreasonable noise was also changed to mean any sound that can be heard off of the property for 15 continuous minutes, or for a total of 30 minutes in a four-hour period.

The amendment passed 4-1 Monday night with Tom Cross voting against.

Before the vote, residents in attendance thanked the supervisors for considering amending the ordinance.

“Thank you for listening to the public comment for the quiet times and I hope you pass the ordinance today,” Peggy Dusablon said.

Short-term rental owners have until November to acquire permits for their rental properties, at a cost of $250.

One resident suggested that the township put a moratorium on new rental properties until the current ones are registered. Solicitor Thomas Nanovic said if the supervisors wouldn’t be legally allowed to put a temporary moratorium on the practice.

The supervisors were also asked to limit the total number of rentals. Nanovic said it would be possible for the supervisors to vote to limit the number of rentals within a certain area, like some municipalities do with undesirable uses such as adult bookstores.
