Pair charged with intent to deliver crystal methamphetamine
A Slatington man has been charged with attempting to sell crystal methamphetamine outside a Dollar General store.
According to the affidavit of probable cause filed by Agent Matt Pavlik of the Office of Attorney General, Bureau of Narcotics Investigations, and officer Chris D’Andrea of the Slatington Borough Police Department in the case against Curt O’Malley and Tyana Fisher:
On Oct. 17, a confidential source provided information that O’Malley, 38, of the 600 block of West Franklin Street, would be at the Dollar General Store in Slatington, with the intent of facilitating a drug transaction of crystal methamphetamine.
O’Malley was known to be wanted for an active warrant from Lehigh County for probation violation pursuant to DUI charges.
Agents of the Office of Attorney General established surveillance on the Dollar General parking lot and identified O’Malley pacing at the southern corner of Dollar General.
Agents observed O’Malley crouching on the side of the building and approached him, identifying themselves as law enforcement and ordered O’Malley to stop and show his hands.
O’Malley fled on foot and ultimately was apprehended by agents underneath a tow truck in the parking lot of Sule’s Collision Center, where O’Malley was found in possession of an electronic scale.
A search of the southern side of the Dollar General revealed two small bags of a crystalline substance concealed under a plastic box where O’Malley had been seen kneeling.
O’Malley was mirandized and provided a written statement that he was contemplating selling Epsom salts represented as crystal methamphetamine to potential customer and/or robbing the customer of their money. O’Malley said that the co-defendant, Fisher, 33, same address, had driven him to the location, and was serving as a lookout.
The two suspected bags of crystal methamphetamine were field tested, and one bag indicated a positive reaction for the presence of crystal methamphetamine.
O’Malley faces charges of possession with intent to deliver a controlled substance; possession of drug paraphernalia; unlawful possession of a controlled substance; and flight to avoid apprehension, trial or punishment.
Fisher faces charges of possession of intent to deliver.
O’Malley is currently incarcerated in the Lehigh County Prison in lieu of $100,000 monetary bail, and scheduled to have a preliminary hearing Nov. 12 in Lehigh County Central Court in Allentown.
Fisher is free on $50,000 unsecured bail, and is scheduled to have a preliminary hearing Nov. 19 before District Judge Tom Clair Creighton of Slatington.
