Carbon County court — guilty pleas

A Carbon County man pleaded guilty to a drug-dealing charge in the county court on Monday.

He was one of 10 defendants in pending criminal cases to enter a guilty plea before Judge Joseph J. Matika.

Weatherly incident

Nicholas Hunter Lambert,

34, of Weatherly, pleaded to one count of possession with intent to deliver a controlled substance, marijuana. He was charged by Weatherly police for an incident on July 12 along First Street where he sold medical marijuana to another individual.

In another case, also occurring on July 12, he pleaded to one count of false report, falsely incriminate another person. He attempted to blame the other person involved in the sale with the possession of the marijuana. It was agreed in a plea deal that the amount of marijuana involved was 3.4 grams.

Lambert’s defense attorney, Robert T. Yurchak, said his client has a history of mental health issues and when on his medication is no problem. He claimed at the time of the incident he was “off his meds.” He added Lambert is receiving counseling for his problem.

On the drug count Matika placed him on probation for 18 months and ordered he get both drug and alcohol and mental health evaluations and follow any recommendations for treatment, supply a DNA sample and render a total of 75 hours of community service. On the false report charge he was placed on probation for a year, concurrent with the drug count.

Other pleas

Louis Joseph Domenico IV,

22, of Saylorsburg, pleaded to one count each of driving under suspension - DUI related and unauthorized use of a motor vehicle. In exchange for the plea a felony 2 count of receiving stolen property was dropped.

Domenico was arrested on June 29 by state police at Fern Ridge following a traffic stop along Interstate 80 in Kidder Township. At the time of the stop the vehicle he was driving was listed as stolen. Domenico is an inmate in the county prison on the charges.

On the suspension count Matika sentenced him to serve six to 12 months in prison with credit for 99 days already served. He was also ordered to make restitution of $135, supply a DNA sample and render 50 hours of community service when paroled. On the unauthorized use charge he was placed on probation for a year, concurrent with the suspension count. On three motor vehicle code summary offenses he was fined a total of $650.90.

Adam Paul Fejes,

30, of Nescopeck, Luzerne County, pleaded to one count of theft, as a misdemeanor 2. The charge was downgraded from a felony 1 in a plea deal with the DA office. He was charged by Weatherly police for an incident on June 24 in Eurana Park. He took cash from a wallet he took from a female’s purse.

He claimed he returned the money, $176, to the victim before police arrived.

He was placed on probation for six months and ordered to render 25 hours of community service and supply a DNA sample.

Jeffrey W. Gerhard,

60, of Weatherly, pleaded to one count of persistent disorderly conduct with a count of simple assault dropped in a plea deal with the DA office.

He was arrested on Aug. 15 by Weatherly police at his residence along Carbon Street, following a domestic incident with his girlfriend.

He admitted to a problem with alcohol but said he is trying to address it.

Matika placed him on probation for six months and ordered he get a drug and alcohol evaluation and follow any recommendation for treatment and render 25 hours of community service.

Sue Ann Collotty,

42, of Lehighton, pleaded to one count of possession of a small amount of marijuana.

She was arrested on Aug. 13, 2019, by Franklin Township police following an incident along Harrity Road in a parking lot area. Methamphetamine was found, the police report indicates. A charge of possession of a controlled substance was dropped in a plea deal.

Matika imposed a fine of $150

Jason Leslie Gual,

41, of Palmerton, pleaded to one count of possession of a small amount of marijuana.

He was arrested by state police at Lehighton after troopers responded on May 24 to a domestic incident at a residence along Covered Bridge Road in Lower Towamensing Township.

He was fined $150.

Jefferson Arguerta,

21, of Hempstead, New York, pleaded to one count of possession of drug paraphernalia.

He was arrested on July 19 by state police at Fern Ridge following a speeding stop along I-80 in Kidder Township. Marijuana was found.

He was placed on probation for six months and ordered to render 25 hours of community service.

John Della-Vecchio,

61, of Palmerton, pleaded in two pending cases to one count each of possession of a small amount of marijuana and possession of drug paraphernalia.

He was arrested on the first count on July 3, 2019, by state police at Lehighton following a speeding stop along Route 248 at Bowmanstown. The second arrest occurred on Dec. 12, 2019, filed by Palmerton police for an incident along Route 248 and another speed stop. He also pleaded to a speeding charge.

Sentencing was deferred to a later date.

Sommer Shaunda Lynn Aguilar,

35, of Great Bend, Susquehanna County, pleaded to three summary offenses of defiant trespass, disorderly conduct and scattering rubbish.

She was arrested on Aug. 17 by state police at Fern Ride along State Street in East Side Borough at the Lehigh Gorge Campground.

On the three counts, Matika sentenced her to serve 18 to 37 days in jail, concurrently, with credit for 37 days already served, and paroled her. She is currently an inmate in the county prison on the charges but won’t be released. She is going to be extradited to Kansas on pending criminal charges.

Sentencing

Andrew Aull-Lawton Kottke,

38, of Sunbury, Northumberland County, who previously pleaded in two pending cases to counts of DUI and possession of drug paraphernalia, was sentenced.

On the DUI count he was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000 and render 25 hours of community service. He was given credit for four days already served and paroled. On the paraphernalia charge he was placed on probation for a year, concurrent with the DUI charge.

He was arrested on April 10, 2016, by Weatherly police for DUI of a controlled substance. He was arrested on Dec. 24, 2016, by Weatherly police when he was found passed out behind the wheel of his car. In that case a DUI charge was dropped and he pleaded to the possession of drug paraphernalia.

Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole or probation.
