Woman is jailed after coming to court with illegal drugs in system
A Carbon County woman appeared in the county court on Tuesday with several illegal drugs in her system and was sentenced to a prison term.
Melissa Lynn Atkinson, 26, of Albrightsville, appeared before Judge Joseph J. Matika to enter a plea to one count of possession of drug paraphernalia for an incident on July 19, 2014, along Route 1003 in Lake Harmony. Kidder Township police stopped Atkinson's vehicle because a person with her had a warrant for his arrest. During a consent search of the vehicle, various drug paraphernalia was found. Atkinson admitted the items were hers. When she appeared to enter the plea, Matika asked her if she had taken any drugs, illegal or not, before appearing court. He said he observed her in the courtroom and that she couldn't keep her eyes open and appeared under the influence. She at first said she had not, but when Matika said he was going to order the adult probation office to conduct a urine test, Atkinson then said she had taken illegal drugs some days earlier.A test was administered and Matika was told by probation personnel that the test revealed drugs in Atkinson's system including heroin and meth, among others.Atkinson admitted entering an inpatient rehab program but left after about a week. She also tried other programs but did not complete them.Atkinson also faced an arrest warrant. She was serving a weekend jail sentence for driving under the influence and failed to appear for her weekend sentence on Feb. 27. She claimed she went to the hospital for a medical problem, and that was the reason she did not appear. However, she admitted she never notified prison officials that she was at a hospital. On the possession count Matika sentenced her to serve 30 days to one year in jail consecutive to the DUI term. He then revoked her weekend sentence and ordered her to serve the remaining time straight. He then ordered her to the custody of the sheriff's department to be placed in the county prison to serve all the jail time imposed. She was also ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance imposed for D&A use, pay court costs of about $1,000, pay a $50 per month supervision fee when released on parole, and render 50 hours of community service when released on parole. It was also noted she has another drug charge pending in the county court.
