Palmerton man enters plea in incident with two teens
A Palmerton man entered a guilty plea in an incident involving two teens as the victims. His son, also involved in the same incident, was placed in a special probation program.
James R. Costenbader, 44, pleaded guilty to one count of defiant trespass before Judge Joseph J. Matika. In exchange for the plea, the commonwealth dropped a charge of simple assault.Costenbader's son, James Ru Costenbader Jr., 20, was also involved in the incident that occurred on Oct. 15, 2013, at 1285 57 Road in Kunkletown, Towamensing Township.State police at Lehighton charged that the two Costenbaders arrived at the address given and entered a barn, where he confronted a 17-year-old male and told the teen, "You don't disrespect my family." He then pushed the teen while the son put the teen in a chokehold. A 17-year-old female who was in the barn at the time attempted break up the fight and she was choked, police said.According to defense counsel Stephen P. Vlossak Sr., an incident occurred earlier in the day involving the male victim and Costenbader's daughter.Matika told Costenbader, "I hope you learned from this that you don't take the law into your own hands."Matika placed Costenbader on probation for a year and ordered he make restitution to the two victims totaling $2,293 (half share of total due), render 50 hours of community service, attend and complete anger management counseling, pay court costs of about $1,000, pay a $50 per month supervision fee while on probation, and have no contact with the victims or enter the property where the incident occurred.Costenbader Jr. was placed in the county's Accelerated Rehabilitation Disposition probation program for a year and ordered to pay an assessment fee of $600, render 50 hours of community service, attend and complete anger management counseling, also make restitution of $2,293, pay court costs of about $1,000, pay a $50 per month supervision fee while in the program, and have no contact with the victims or enter the property in question.
