Carbon County court

A Carbon County man entered guilty pleas on Monday in the county court to two criminal counts stemming from a domestic incident.

He was one of six defendants in pending criminal cases to enter a guilty plea before Judge Joseph J. Matika.

Franklin incident

Anthony J. Tatasciore,

36, of Palmerton, pleaded to one count each of recklessly endangering another person and resisting arrest. In exchange for the plea the district attorney’s office dropped a felony 2 count of arson-endangering property, reckless endangerment and misdemeanor count of simple assault and a summary charge of harassment.

He was charged following an incident on Dec. 15, 2019. State police at Lehighton responded to a domestic incident in the 1100 block of Fairyland Road in Franklin Township. Tatasciore was involved in a dispute with his wife. He was taken to the Lehighton hospital for a mental health evaluation but left the facility and made his way back to the residence. Troopers arrived back on scene and entered the home and found smoke. They found Tatasciore in the kitchen area and burnt items smoldering on the stove.

It was noted he and his wife have reconciled.

Matika sentenced him to serve six to 23 months in prison on both counts, with the terms running concurrently. He was also ordered to get both drug and alcohol and mental health evaluations and follow any recommendations for treatment, supply a DNA sample and render 75 hours of community service.

He was given credit for 185 days already served in prison on the charges and paroled.

Other pleas

Oliberto Vega,

45, of Reading, pleaded to one count of simple assault. In exchange for the plea, charges of stalking, another simple assault count and a summary harassment count were dropped in a plea deal with the DA.

Vega was arrested on Sept. 25, 2017, at the Panther Valley High School football stadium in Lansford. Police responded to the stadium to a report of an altercation in progress. Vega was involved in a dispute with others at a football game.

Vega said his daughter, a student at PVHS at the time, got into an argument with another female from school and it escalated. He said he was defending his daughter but also admitted it was wrong.

Matika placed him on probation for a year and ordered he supply a DNA sample, render 50 hours of community service and have no contact with the victim.

Maggie May Magrini,

33, of Nanticoke, Luzerne County, pleaded to one count of resisting arrest.

She was arrested on May 27, 2018, by Lansford police in the 300 block of West Kline Avenue. Police responded to the area for a report of a disturbance. Magrini was the one causing the disturbance and resisted officers when placed under arrest.

She was placed on probation for a year and ordered to get a drug and alcohol evaluation and render 50 hours of community service.

David J. Derby Jr.,

29, of Summit Hill, pleaded to one count of fleeing or attempting to elude police, a misdemeanor 2. Five summary motor vehicle code violations were dropped in a plea deal.

He was arrested on April 6, 2018, by Summit Hill police in the 400 block of West White Street after fleeing them when they attempted a vehicle stop.

Matika placed him on probation for a year and ordered he render 50 hours of community service.

Amy L. Freed,

34, of Wilkes-Barre, pleaded to a summary offense of disorderly conduct. In exchange for the plea, misdemeanor counts of possession of a controlled substance and possession of drug paraphernalia were dropped in a plea deal.

She was arrested on March 11, 2019, by Palmerton police at a residence along Lehigh Avenue. Police were serving a warrant on her issued out of Northampton County when she caused a disturbance. Methamphetamine was found, according to the police report, but the drug counts were dropped.

Matika imposed a fine of $150.

Amberlynn Erdman,

29, of Andreas, pleaded to one count of driving under suspension - DUI related and obstructed window, both summary offenses. A misdemeanor charge of false identification to law enforcement was dropped in a plea deal.

She was arrested on March 3, 2019, by state police at Lehighton along White Street in Bowmanstown following a traffic stop. At the stop she gave a false name, but that charge was dropped.

On the suspension charge she was placed for 60 days on electronic monitoring in the new restrictive probation program and fined $500. On the window charge she was fined $25.

Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
