Man pleads to taking money from alumni association

A Carbon County man admitted in the county court on Monday to using a credit card belonging to the Weatherly High School Alumni Association for his own purposes.

Todd A. Gimbi, 57, of Weatherly, pleaded guilty before Judge Joseph J. Matika to one count of forgery, as a misdemeanor 1. In a plea deal with the district attorney’s office a forgery count that was rated a felony 2, was downgraded to a misdemeanor one and two felony 3 counts of access device fraud and unauthorized use and deceitful business practices were dropped. It was noted the association officers agreed to the plea deal.

Gimbi was arrested by Weatherly police after the association learned he had opened a credit card account using the association’s name and then used the card for his own purposes.

Gimbi told the court he didn’t realize the card was not his, but Matika questioned that reasoning.

Matika noted the card had the name of the association on it with Gimbi’s, and that should have told the defendant that the card was not his to use.

Gimbi said he was an officer in the association since it began, served as president and also was in charge of membership. Gimbi has been in the county prison since his arrest.

A character witness was present, noting Gimbi’s work and participation in his church.

Matika sentenced him to serve 30 days to 23 months in prison, make restitution to the association for $11,182.80, supply a DNA sample, render 100 hours of community service, not be a member of any nonprofit organization during the length of the sentence, pay court costs of about $1,000 and pay a $50 per month supervision fee while on parole.

He was given credit for 43 days already served and paroled.

Gimbi
