A Pittston man who pleaded no contest to stalking and harassment in Tamaqua was sentenced to up to nine months in jail, but was immediately released on parole.

James B. McElroy, 50, was charged by borough Police Officer Karl L. Harig with committing the crimes in October 2024.

As a result of the proceedings, the two stalking charges were dropped, leaving one count of harassment.

McElroy was sentenced by Schuylkill County President Judge Jacqueline L. Russell.

She sentenced him to nine months, but gave him credit for the times he has already served since March 30.

McElroy is required to perform 10 hours of community service; pay court costs, fees and fines; obtain mental health, anger management, and drug and alcohol evaluations and comply with any recommendations.

• David A. Legutko, 44, Port Carbon, is serving up to 90 days in Schuylkill County Prison after running from Tamaqua police after a traffic stop.

Officer Andrew J. Seip had charged Legutko with fleeing, evading arrest, driving with a suspended license, careless driving, speeding, passing when prohibited, and disregarding traffic lanes on Dec. 5, 2025.

He pleaded guilty of fleeing, driving with a suspended license, passing when prohibited, and disregarding traffic lanes.

The remaining charges were dropped.

Judge James P. Goodman sentenced Legutko to serve up to 12 months in jail on the fleeing charge; up to 90 days on the license charge plus a $500 fine, to be served at the same time; and fined him $25 each on the passing and traffic lane charges.

Legutko was also ordered to pay court costs, undergo a drug and alcohol evaluations and perform 10 hours of community service.
