Man waives charges of assault, resisting arrest
A Kunkletown man has waived charges stemming from an alleged assault in Polk Township.
According to the affidavit of probable cause filed by Trooper Daniel Magarelli of the Pennsylvania State Police, Lehighton barracks, in the case against Michael Schaming:
At 1:04 p.m. June 15, troopers were dispatched to a home in the 200 section of Lower Valley Drive, Polk Township, for the report of an active domestic disturbance involving a man and woman.
The trooper met the woman in the driveway and she said she had been in an argument with Schaming, 54, after Schaming began recording her with his cellphone and livestreaming the encounter on Facebook.
The woman said when she attempted to take possession of the phone to stop the livestream, a physical struggle ensued.
She said Schaming struck her in the chest with a closed fist. The parties subsequently separated, and the woman contacted 911 to report the incident.
While the woman was speaking to police, Schaming was at the door, recording the interaction with his phone.
Police inquired whether Schaming possessed any weapons, and during that interaction, Schaming moved back into the residence.
He resisted arrest, so Troopers John Heffner and Robert Miller took Schaming to the ground and repeatedly issued verbal commands for him to stop resisting and place his hands behind his back.
Schaming kicked Miller in the chest and face, and bit Heffner on the left forearm.
Miller deployed his Taser in drive-stun mode in an attempt to gain compliance; however, Schaming continued to resist. After a prolonged physical struggle requiring a substantial amount of force, troopers were ultimately able to place Schaming into custody.
Schaming had facial lacerations and Heffner had bloody abrasions and scrapes to his right knuckles.
Heffner advised that Schaming’s bite did not break his skin.
Schaming faces charges on three counts of harassment, two counts of aggravated assault, and one count of resisting arrest.
He is free on $30,000 monetary bail and is scheduled for formal arraignment in the Monroe County Court of Common Pleas on Aug. 10.
