Weatherly approves vacating three borough streets

Weatherly Borough Council approved vacating portions of three paper streets Monday night, despite the Weatherly Area School District reversing its stance on the move.

The borough adopted an ordinance vacating portions of Blakeslee Avenue, Walnut Alley and Seventh Street.

Solicitor James Nanovic explained that the borough has a petition from property owners seeking the action, as well as signatures from all the adjoining property owners who did not object.

The Weatherly Area School District was among those adjoining property owners that agreed to vacate these paper streets, he said.

“Based on that, we have advertised that, it’s ready to be adopted tonight, if council wished to do so,” Nanovic said.

He then explained that he got an email on April 8 from the Slusser Law firm saying the school district no longer consents or supports the vacation of these streets.

“Apparently, the school district has changed their mind,” Nanovic said. “It doesn’t give any reason for doing so.”

Mayor Michael Bellizia said that this has been going on for some time, and it’s been back and forth during that time. Nanovic agreed, saying the district gave consent, and then a school board member contacted the borough saying no. Then the borough contacted the superintendent, who said the district had consented.

“Now, we get this saying they don’t,” Nanovic said. “That’s the part of the flip-flopping that we’re getting.”

Bellizia said that he spoke to the school board president, who said that they were good to go with vacating the streets and then someone wasn’t in agreement. He hadn’t heard anything further from the school board president since, he said.

Bellizia left the matter up to council, which voted unanimously to vacate portions of the paper streets.
