Carbon County Court - Guilty pleas

Carbon County President Judge Roger N. Nanovic on Dec. 8 accepted guilty pleas from and sentenced the following people.

David Lee Brown, 53, of Bowmanstown, was charged with driving under the influence of a controlled substance, first offense; DUI: controlled substance, impaired ability, first offense; duties at stop sign, having an improper muffler; and careless driving on March 21, 2022.

Brown admitted to the first charge, and Judge Nanovic fined him $1,000, and ordered him to pay court costs and a $50 monthly supervision fee; to serve 73 hours to six months in the Carbon County Correctional Facility, to be served after he completes a federal sentence he’s serving; successfully complete outpatient treatment; surrender his license for 12 months, and complete the Alcohol Highway Safety Program.

The remaining charges were dropped.

Timothy Stephen Keer, 59, of Coaldale, was charged with DUI: Incapable of driving safely, second offense; failing to keep right; and careless driving on Aug, 26, 2016.

He admitted to the DUI charge, and Judge Matika fined him $300; and ordered him to pay court costs, a $100 LiveScan fee, and a $50 monthly supervision fee; ordered him to serve three to six months in jail, beginning Jan. 4, 2024; undergo a mental health evaluation; successfully complete an outpatient treatment program; and surrender his license for 12 months.

In a separate case, Keer was charged with DUI: incapable of driving safely, third offense; driving while his license was suspended or revoked; and careless driving on June 26, 2017.

On the charge of DUI: incapable of driving safely, Judge Nanovic fined him $2,500; ordered him to pay court costs, a $100 LiveScan fee and a $50 monthly supervision fee; ordered him to serve two to five years in state prison, with one day credit, beginning Jan. 4, 2024 and to be served concurrently with his previous sentence; and surrender his license for 18 months.

Keer also admitted to driving while his license was suspended or revoked. On that charge, Judge Nanovic fined him $500 and ordered him to serve 60 days in state prison, to be served at the same time as his previous sentences.

Tammy Jean Heiserman, 47, of Lehighton, was charged with driving while her license was suspended or revoked; DUI: controlled substance, first offense; DUI: controlled substance, impaired ability, first offense; misuse of plate/card; and careless driving on June 14, 2022.

She admitted to the charge of DUI: controlled substance, impaired ability, and Judge Nanovic fined her $1,000; he ordered her to pay court costs and a $50 monthly supervision fee; serve 72 hours to six months in jail, with four days credit; surrender her license for 12 months; and complete the Alcohol Highway Safety Program.

William Norman Derau, 49, of Lehighton, was charged with retail theft by under ringing; conspiracy to commit retail theft; and retail theft on July 17, 2020.

He admitted to the retail theft charge, and Judge Nanovic fined him $300 and ordered him to pay a $100 LiveScan fee.

The remaining charges were dropped.

Robert Edwin McNabb, 45, of Allentown, was charged with burglary, person present, bodily injury; criminal trespass; simple assault; harassment; and disorderly conduct on Oct. 23, 2021.

He admitted to the harassment charge, and Judge Nanovic fined him $300, and ordered him to pay court costs. The remaining charges were dropped.

Xavier F. Olivero, 24, of Bellefont, Centre County, was charged with robbery; criminal conspiracy to engage in robbery; aggravated assault; two counts of simple assault; and theft by unlawful taking on Aug, 4, 2022.

He admitted to the conspiracy and simple assault charges.

Judge Nanovic ordered him to repay $6,122 to Lansford borough on the conspiracy charge; pay court costs, a $100 LiveScan fee; serve two to four years in state prison, with 116 days credit, and followed by one year on probation; undergo a comprehensive drug and alcohol evaluation; have no contact with the victim; repay the victim $80.

On the assault charge, Judge Nanovic ordered Olivero to serve three to 12 months in state prison, to be served at the same time as his other sentence.
