Carbon County - Sentencings

Carbon County Court Judge Joseph J. Matika recently sentenced 10 people after negotiating plea agreements to criminal charges, most involving drugs or alcohol.

Angel Eugenio Batista, 22, of Kunkletown, was charged with driving under the influence of a controlled substance, first offense; driving under the influence, impaired ability, first offense; and careless driving on March 3, 2021.

On the charge of DUI controlled substance, Judge Matika ordered him to pay a $1,000 fine; serve 72 hours to six months in Carbon County prison; successfully complete Alcohol Highway Safety School; surrender his driver’s license for 12 months; and to perform 25 hours of community service.

Jeffrey Martin Butz, 44, of Lehighton, was charged with driving under the influence, highest rate of alcohol, second offense; driving under the influence, incapable of driving safely, second offense; driving an unregistered vehicle; exceeding the maximum speed limit by 15 mph; and careless driving on June 26, 2022.

On the charge of impaired driving, Judge Matika ordered him to pay court costs; a $1,000 fine; serve five days to six months in Carbon County prison; enroll in outpatient treatment; successfully complete Alcohol Highway Safety School; surrender his driver’s license for 12 months; and to perform 25 hours of community service.

Michael Frank Gerber, 40, of Jim Thorpe, was charged with manufacture, delivery, or possession with intent to manufacture or deliver a controlled substance and possession of a controlled substance on Jan. 13, 2021.

On the drug possession charge, Judge Matika ordered him to pay court costs; $50 monthly supervision fee; pay a LiveScan fee of $100; serve one year on probation; under a drug and alcohol evaluation; and to perform 50 hours of community service.

Matika sentenced Gerber to the same punishment, to be served at the same time, on a second case.

In that matter, Gerber was charged with possession of a controlled substance and possession of drug paraphernalia on July 14, 2021.

Ruben C. Girau, 51, of Danielsville, was charged with driving under the influence, highest rate of alcohol, second offense; driving under the influence, incapable of driving safely, second offense; careless driving; and exceeding 55 mph by 35 mph on Nov. 13, 2022.

On the DUI safety charge, Judge Matika ordered him to pay a $300 fine; pay a $50 monthly supervision fee; pay court costs; pay a LiveScan fee of $100; serve five days to six months in Carbon County prison; successfully complete Alcohol Highway Safety School; enroll in outpatient treatment; surrender his driver’s license for 12 months; and to perform 25 hours of community service. He was fined $25 on the careless driving charge.

Anthony Dominick Camporini, 30, of Stroudsburg, was charged with driving under the influence, incapable of driving safely, second offense; and driving under the influence, highest rate of alcohol, second offense on July 17, 2022.

On the DUI impaired driving charge, Judge Matika ordered him to pay court costs; a $300 fine; serve 10 days to six months in Carbon County prison, to be served on consecutive weekends; enroll in outpatient treatment; successfully complete Alcohol Highway Safety School; surrender his driver’s license for 12 months; and to perform 25 hours of community service.

Jimmy Rogilio Lane, 46, of Tobyhanna, was charged with driving under the influence, incapable of driving safely; and driving under the influence, highest rate of alcohol on June 5, 2021.

On the DUI impaired driving charge, Judge Matika ordered him to pay court costs; a $500 fine; pay $500 restitution to the victim; serve 48 hours to six months in Carbon County prison, with three days credit; enroll in outpatient treatment; successfully complete Alcohol Highway Safety School; surrender his driver’s license for 12 months; and to perform 25 hours of community service.

Dennis Roland Meixsell, 44, of Palmerton, was charged with driving under the influence, highest rate of alcohol; driving under the influence, incapable of driving safely; and careless driving on Dec. 3, 2022.

On the DUI impaired driving charge, Judge Matika ordered him to pay court costs; a $300 fine; serve six months on probation; a $50 monthly supervision fee; successfully complete Alcohol Highway Safety School; and to perform 25 hours of community service.

Jason Lee Moyer, 41, of Andreas, was charged with driving under the influence, highest rate of alcohol; driving under the influence, incapable of driving safely; and careless driving on March 6, 2022.

On the DUI impaired driving charge, Judge Matika ordered him to pay court costs; a $300 fine; serve six months on probation; a $50 monthly supervision fee; enroll in a treatment intervention group; successfully complete Alcohol Highway Safety School; and to perform 25 hours of community service.

John Victor Oswald, 61, of Lehighton, was charged with driving under the influence, incapable of driving safely; driving under the influence, highest rate of alcohol; driving without a license; and careless driving on May 28, 2022.

On the DUI impaired driving charge, Judge Matika ordered him to pay court costs; a $300 fine; serve six months on probation; a $50 monthly supervision fee; enroll in short-term inpatient treatment; and successfully complete Alcohol Highway Safety School.

Shane M. Reed, 38, of Lehighton, was charged with driving under the influence, highest rate of alcohol; driving under the influence, incapable of driving safely; driving an unregistered vehicle; and careless driving on Dec. 12, 2022.

On the DUI impaired driving charge, Judge Matika ordered him to pay court costs; a $300 fine; serve six months on probation; a $50 monthly supervision fee; enroll in short-term inpatient treatment; perform 25 hours of community service; and successfully complete Alcohol Highway Safety School.
