Tamaqua man is sentenced for selling drugs

A Tamaqua man must serve 8 to 16 years in state prison for selling drugs in Tamaqua last year.

President Judge William E. Baldwin ordered Justin Neff, 36, to serve two to four years on each of the four drug counts he was convicted of in a September trial. He ordered they be served consecutively. Neff gets credit for 414 days time served in the Schuylkill County Prison.

First Assistant District Attorney Mike Stine said the sentencing was in line with what the prosecution requested.

“Obviously, we think it was a fair result,” he said.

A jury found Neff guilty of four counts each of manufacture, delivery or possession with intent to manufacture or deliver, criminal use of a communications facility and possession of a controlled substance.

Neff appeared by video conference from the prison.

Assistant District Attorney Jennifer Foose prosecuted the case.

Bill Burke, Neff’s attorney, said they will appeal. He had asked for concurrent sentencing for Neff.

“The sentence speaks for itself,” he said.

Tamaqua Police charged Neff with selling heroin and fentanyl after meeting a confidential informant on North Elizabeth Street and Glenwood Avenue on May 13, May 20, 21 and 22. The interactions were recorded on video. Neff sold the drugs for $40 each time.

In addition to the Schuylkill County sentence, Neff has a case in Carbon county where he was sentenced May 20 to DUI controlled substance-impaired ability, driving while blood alcohol level was 0.02 or greater with a suspended license. He was sentenced to one to five years. His license was suspended for 18 months, required to complete outpatient treatment and ordered to complete an alcohol highway safety program.
