Darby man charged with fleeing police

A Delaware County man has been charged with fleeing police following a traffic stop in Tamaqua.

According to the affidavit of probable cause filed by officer Aaron Koehler of the Tamaqua Borough Police Department in the case against Donte Brown Mosley:

At 8:58 p.m. Sept. 5, Koehler and officer Christopher Cordes were on patrol in the area of the old Sunoco on Center Street when a black Buick passed them heading north on Route 309.

The vehicle’s registration light was not functioning, and when the plate was ran, it did not come back to anything. There was also no temp tag or sticker to be seen.

Upon stopping the vehicle at Pine and E. Broad, both officers made contact on the passenger side and then made contact with the driver, Brown Mosley, 33, of Darby, and the passenger.

The passenger was trying to show police the paperwork for the vehicle, but when Koehler asked for Brown Mosley’s ID, he reached for the shifter, shifted into first and fled from the stop.

Officers then entered their patrol vehicle and followed behind without lights and sirens, and the Schuylkill County Communications Center was notified that the Buick fled the stop.

The Buick went up Greenwood Street, and by the time police turned onto Greenwood, the Buick was almost out of sight.

Police continued up Greenwood, and Koehler then deactivated his emergency lights and advised the Comm Center that the vehicle had lost police, and to let surrounding agencies know.

Police continued on regular patrol down Market Street to Elm Street, and then made a left on Elm and went to Pine Street.

Upon arriving at Pine Street, police made a left onto Pine, at which time the Buick sped toward them in their lane of travel, going past several vehicles that were waiting at the red light.

Brown Mosley drove through the red light and headed north on 309, at which time Koehler activated his emergency lights and sirens and had to make a U-turn, before proceeding to catch up with Brown Mosley just after ALL American Jeep.

At this time, the Buick started to slow from a speed of about 55 miles per hour to below 40 mph, and the passenger was hanging out the window, waving paperwork in his hand as the Buick slowed down even more.

Police could see through the rear view mirror that the passenger was trying to get Brown Mosley to stop, which was just after Seitz Bros. and before Zieglers, when the Buick stopped.

Both occupants were taken into custody and transported back to the station. The vehicle was towed by Hopes Towing.

Brown Mosley faces charges of fleeing or attempting to elude officer; recklessly endangering another person; careless driving; reckless driving; disregard traffic lane; general lighting requirements; and failure to stop at red signal.

He is currently incarcerated in the Schuylkill County Prison in lieu of $50,000 monetary bail, and scheduled to have a preliminary hearing Oct. 5 before District Judge Stephen J. Bayer of Tamaqua.
