Carbon County court — DUI

A Carbon County man was sentenced to a prison term on Tuesday after pleading guilty to a driving under the influence charge.

He was one of eight defendants to enter a plea before or be sentenced by Judge Joseph J. Matika.

Vehicle stop

Joseph L Moyer Sr., 68, of Lehighton, was sentenced to serve 90 days to 60 months in prison, pay a fine of $1,500 and his license was suspended for 18 months.

Moyer was arrested on June 30, 2020, following a vehicle stop by Summit Hill police along White Bear Drive. He pleaded to DUI of a controlled substance.

He was also ordered to render 100 hours of community service and supply a DNA sample.

He will begin serving his prison term at 10 a.m. on April 23 and serve it on consecutive two-day weekends.

Other pleas

Mark Duffy, 37, of Lehighton, pleaded to one count of persistent disorderly conduct. He was arrested on July 17, 2020, by Franklin Township police at the Comfort Inn & Suites along Interchange Road. Police were called to the inn because of a disturbance. Duffy was arrested for causing the disturbance.

He was placed on probation for a year and ordered to get a drug and alcohol evaluation and follow any recommendation for treatment, render 50 hours of community service, attend and successfully complete an anger management course and make restitution to the inn for $200.

His plea was entered via video conference from the county prison where he is an inmate on other charges.

Christina Lynn Kieffer, 33, of York, and formerly of Lansford, pleaded to one count of defiant trespass.

She was arrested on Aug. 3, 2017, by Lansford police for illegally entering onto the property of the LCN company in the area of Dock Street and Edgemont Road.

She was placed on probation for six months and ordered to render 25 hours of community service and stay off the LCN property.

Marvin Patrick Frederick Jr., 27, of Rosedale, New York, pleaded to one count of possession of a small amount of marijuana. He was arrested on Sept. 13, 2015, following a traffic stop by state police at Fern Ridge along Interstate 80 in East Side Borough. The case had 16 continuances filed.

Matika imposed a fine of $150.

His plea was entered via Zoom from New York.

Sentencings

The following defendants were sentenced after previously entering guilty pleas.

Benjamin Franklin Williams, 35, of Bowmanstown, was sentenced on charges of DUI and possession of drug paraphernalia for an incident on July 24, 2020, along Interchange Road in Franklin Township, filed by state police at Lehighton; and on a theft count for an incident on May 25, 2018, filed by state police at Lehighton, for an incident in East Penn Township.

On the DUI charge he was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, license suspended for a year and render 25 hours of community service. On the drug count he was placed on probation for a year, concurrent to the DUI charge.

On the theft count he was placed on probation for a year, consecutive to the DUI charge, and ordered to make restitution of $1,057.50 to the victim, get a drug and alcohol evaluation, render another 50 hours of community service and have no contact with the victim.

The start of his prison term was delayed until May 14 at 10 a.m. as Williams was to enter an inpatient drug treatment program on Tuesday afternoon for a 28-day period.

Nicholas R. Brann, 35, of Kunkletown, was placed on probation for six months and ordered to pay a fine of $300 for DUI, first offense. He was arrested Nov. 25, 2020, by state police Fern Ridge along Route 534 in Penn Forest Township. A test revealed a 0.13 BAC.

He must also render 25 hours of community service.

Destinee D. Dalrymple, 25, of Kunkletown, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, her license was suspended for a year and she must render 25 hours of community service on a DUI charge. She was arrested on May 28, 2017, for DUI of a controlled substance by state police at Lehighton along Pohopoco Drive in Towamensing Township.

On a charge of possession of drug paraphernalia she was placed on probation for a year, concurrent with the DUI, and render 50 hours of community service. She was arrested on Jan. 15, 2018, by Lehighton police following a traffic stop along Route 443.

She was given credit for three days spent in an inpatient program and paroled. She actually spent three months in the program.

Christine Nichole King, 42, of Lansford, was sentenced to serve 72 hours to six months in jail, pay a fine of $1,000, her license was suspended for a year and she must render 25 hours of community service on a DUI charge. She was arrested on March 19, 2019, by Lansford police for DUI of a controlled substance along Patterson Street.

She was given credit for one day already served and will begin serving the remaining two days at 6 p.m. on April 16.

ARD

Tyson Elijah Taylor, 18, of Allentown, was placed in the county’s Accelerated Rehabilitation Disposition probation program on a DUI charge. He was arrested on Aug. 17, 2020, along Blue Mountain Drive in Lower Towamensing Township, by state police at Lehighton, for DUI of a controlled substance.

He was placed in the program for a year and assessed $600 for the cost of the program and ordered to render 50 hours of community service and license suspended for 90 days. If he successfully completes the program the charge will be expunged from his record.

Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole or probation.
