Coaldale man charged with grabbing boy by throat

Coaldale Police filed charges against a borough man after a male juvenile walked into the borough police station last month and said he grabbed him by the throat.

Gilbert Fransico Rivera, 35, is charged with a strangulation, a felony, and one misdemeanor each of simple assault and endangering the welfare of children. Charges were filed in Magisterial District Judge Stephen Bayer’s office, Tamaqua, Nov. 27.

Bail was set at $10,000 unsecured. A preliminary hearing is set for Jan. 26 in Bayer’s office.

The juvenile, who walked into the police with only pants and who had visible marks on his neck police said, told them he was “playing a video game with his brother” when they got into an argument.

Rivera, who is identified as the paramour of his mother, according to charging documents, intervened. At one point, the alleged victim went to his room and closed the door. Rivera followed him, and later grabbed the juvenile “by the throat,” thereby causing him to punch Rivera, according to the affidavit.

Family members initially prevented the juvenile from leaving after separating the two, documents show.
