Carbon woman given prison term in 6 criminal cases

A Carbon County woman who previously entered guilty pleas in six pending criminal cases was sentenced to a county prison term on Thursday morning in the county court.

Ashly N. Tansley, 29, of Lehighton, was sentenced by Judge Steven R. Serfass to serve a total of nine to one day less 24 months in prison followed by one year of probation.

She had pleaded to two counts of retail theft, three counts of possession of drug paraphernalia and one count of theft.

One retail theft occurred at Mallard Markets in Lehighton on Aug. 21, 2018; and the second at the Walmart store in Mahoning Township on June 23, 2017. The theft count was for stealing a BMX bicycle from a home in Mahoning Township on April 26, 2017. The three drug arrests occurred on Feb. 6, 2017, along Jamestown Street in Mahoning Township; May 5, 2017, at the Walmart store; and the third on May 3, 2017, in the 100 block of South First Street in Lehighton. In two of the drug incidents, charges of possession of a controlled substance were dropped in a plea agreement with the district attorney’s office.

Court-appointed defense attorney Carol Wildoner Walbert said Tansley had a difficult life, living some of the time in the streets. She said she attempted suicide a few times, has six children, and a drug addiction problem. Wildoner Walbert said Tansley has no violent crimes in her record and struggles with mental health issues as well. She said Tansley was a “woman who has not had a shot at life.”

Serfass said he understood the problems of the defendant but he had to take into consideration the crimes committed and the victims of the crimes in rejecting a time-served sentence.

In addition to the prison term, Serfass ordered Tansley to make total restitution of $117.85, get both drug and alcohol and mental health evaluations and follow any recommendations for treatment, supply a DNA sample, render a total of 100 hours of community service after she is paroled, stay out of Walmart and Mallard Markets, pay court costs of about $1,000 and a $50 per month supervision fee while on parole and probation.

She was given credit for 195 days already served and will begin serving the balance of her prison term on April 4 at 9 a.m.
