Carbon County court — ARD

Eight people charged with criminal offenses were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program on Thursday by President Judge Roger N. Nanovic II.

If a person successfully completes all conditions of the program their record will be wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges.

A person does not admit guilt in entering the program.

All were placed for a year, unless otherwise noted.

Dylan Thomas Craig-Zelena

, 25, of Palmerton, was placed on a driving under the influence of a controlled substance charge. He was arrested on Nov. 11, 2017, along Forest Inn Road in Lower Towamensing Township by state police at Lehighton. A test revealed the presence of a controlled substance.

He was assessed $650 for the cost of the program and his license was suspended for 60 days.

Kyle Ray Devatt

, 30, of Kunkletown, was placed for six months on a simple assault charge. He was arrested on May 5 by state police at Lehighton for an incident at Beltzville State Park.

He was assessed $450 and ordered to get a drug and alcohol evaluation and follow any recommendation for treatment and make restitution in an amount to be determined by the adult probation office.

Michael James McNamara

, 36, of Wind Gap, was placed for six months on a simple assault charge. This is a companion case to Devatt with the same facts and victim.

He was assessed $450 and ordered to get a D&A evaluation and make restitution as determined.

Samantha Jo Muniz

, 20, of Tobyhanna, was placed for six months on a charge of possession of a small amount of marijuana. She was arrested on May 25 by state police at Lehighton in the 8100 block of Interchange Road in Towamensing Township.

She was assessed $450 and ordered to get a D&A evaluation.

Thomas Allyn Phillips

, 38, of Castle Rock, Colorado, was placed on a DUI charge. He was arrested on April 5 by Franklin Township police along Long Run Road. A test revealed a 0.24 BAC.

He was assessed $550, and his license was suspended for 60 days.

Darius Dailey

, 26, of Brooklyn, New York, was placed for six months on a charge of false identification to law enforcement. He was arrested following a traffic stop along Route 443 by Lehighton police on June 18.

He was assessed $450.

Kimberly Ann Evert

, 54, of Lehighton, was placed on a DUI of controlled substance charge. She was arrested on Aug. 23, 2017, along Franklin Heights by Franklin Township police. A test revealed the presence of a controlled substance.

She was assessed $650, zero tolerance imposed on drug or alcohol use, and her license was suspended for 60 days.

Andrea Monique Ferrell

, 28, of Lehighton, was placed on a DUI of controlled substance charge. She was arrested on June 18 by Lehighton police along Route 443. A test revealed the presence of a controlled substance.

She was assessed $600 and her license was suspended for 60 days.

Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee while in the program and those charged with DUI must follow any recommendation of their drug and alcohol evaluation.
