New Jersey man faces deportation after serving time in assault case

A New Jersey man is facing deportation after he entered guilty pleas in Carbon County court on Thursday to assault counts.

He entered a guilty plea before President Judge Roger N. Nanovic II.

Bogdan Galay, 28, of Trenton, pleaded to two counts of aggravated assault and one count of resisting arrest for an incident on Jan. 1.

State police at Lehighton responded to a residence along Woods Drive in Lower Towamensing Township for a reported domestic incident. On scene troopers found other people in the residence attempting to subdue Galay. He had assaulted a woman in the residence. The arrest report indicated the woman showed signs of being assaulted.

When attempting to take Galay into custody, he kicked one trooper in the groin area and also kicked an EMT unit member, who had responded due to injuries suffered by the woman and Galay.

Defense Attorney Michael J. Donohue told Nanovic that his client had consulted with an attorney who specializes in immigration issues and was told he will be deported to Ukraine after he serves his prison term.

Nanovic then sentenced him to the plea bargain term of five to 10 months in prison and ordered he get a drug and alcohol evaluation and follow any recommendation for treatment.

Galay, who has been in prison since the incident, was given credit for 239 days. When he serves his minimum term he will be turned over to immigration officials who have a detainer filed against him.

Galay must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole or probation.
