Carbon County court — DUI

A Carbon County man was given a second state prison term for drunken driving, but it won’t extend his time spent in a state facility.

He was one of five defendants to be sentenced on driving under the influence charges.

Edward Charles Kleintop

, 45, of Lehighton, was sentenced by President Judge Roger N. Nanovic II to serve two to five years in a state correctional institution.

Kleintop was arrested on Sept. 30 by state police at Lehighton along Delaware Avenue in Palmerton. A test revealed the presence of a controlled substance.

He was originally charged with 13 counts including possession of a controlled substance, possession of drug paraphernalia, possession of a small amount of marijuana and six motor vehicle code violations.

All but the DUI count was dropped in a plea bargain with the district attorney’s office.

On Sept. 5 Nanovic sentenced Kleintop in another DUI case to serve two to five years in a state prison. On Tuesday, Nanovic ruled the new sentence would run concurrent with the Sept. 5 sentence.

Kleintop is currently an inmate at SCI-Graterford.

Nanovic also ordered Kleintop to pay a fine of $2,500, license suspended for 18 months and get a mental health evaluation. On a summary motor vehicle code violation he was fined $25 and costs.

Other cases

Rodolfo Zelaya

, 63, of Palmerton, was placed on probation for six months and ordered to pay a fine of $300.

He was arrested on Sept. 10, 2016, along Fireline Road in Bowmanstown by state police at Lehighton. He refused a blood test.

Ronald A. Cohen

, 66, of Parryville, was sentenced to serve 72 hours to six months in jail, a fine of $1,000 and one-year license suspension.

He previously pleaded guilty to the charge in exchange for a second case involving DUI being withdrawn by the district attorney’s office.

Both cases have a long history in the system with 26 continuances filed in the case in which he entered a plea and 16 continuances granted in the case which was withdrawn.

Cohen was arrested on June 17, 2013, by state police at Lehighton along White Street in Bowmanstown. He was charged with DUI of a controlled substance.

The case that was withdrawn occurred on Sept. 22, 2013, also involving state police at Lehighton.

Nanovic agreed to permit Colon to enter an inpatient rehabilitation facility for 14 days and credit it against the prison term, providing he successfully completes the program. If not, he would have to serve the 72 hours in prison starting Nov. 10 at 8 a.m.

Darrin Jon Riley,

52, of Danielsville, was placed on probation for six months and ordered to pay a fine of $300.

He was arrested on Sept. 4, 2015, by state police at Lehighton who stopped him for tinted windows.

He was also fined a total of $50 and costs on two motor vehicle code violations.

Thomas Scott Scherer,

36, of Palmerton, was sentenced on DUI and driving under suspension — DUI related charges.

He was sentenced to serve one to 24 months on the DUI charge, pay a fine of $1,500 and one year license suspension.

On the second count he was sentenced to serve 90 days in jail and a fine of $1,000. The jail terms run concurrently. On a motor vehicle charge he was fined $25 and costs.

He was arrested on Oct. 28, 2016, by state police at Lehighton.

He will begin the jail term on Nov. 2 and 7 p.m. and serve it on consecutive three day weekends from Thursday through Sunday.

Each defendant must also pay court costs of about $1,000, pay a $50 per month supervision fee while on probation or parole and follow any recommendation of their drug and alcohol evaluation.
