Police: Son beat attorney with bat

Months of death threats by his first-born son ended Father's Day with Barnesville lawyer Gary D. Marchalk lying dead in a pool of blood, an aluminum baseball bat at his feet.

The son, Michael D. Marchalk, 37, fled in Gary Marchalk's car. He failed to show up Monday at a drug treatment program as planned, and was last determined to have been at a Greyhound bus terminal in Philadelphia.State police at Frackville have charged him with criminal homicide, murder of the first degree, murder of the second degree, murder of the third degree, voluntary manslaughter, aggravated assault, robbery, theft, theft of a motor vehicle, access device fraud, and recklessly endangering another person.As of press time, police have not located him.Here's how the situation unfolded, according to an affidavit of probable cause filed by trooper Joseph W. Hall with District Judge Christina E. Hale of Frackville:Gary Marchalk's younger son, Matthew D. Marchalk, 33, called Schuylkill County 911 at 11:47 a.m. Monday, saying his father appeared to be dead.State police rushed to the house, at 21 Pear St., where they found Marchalk's battered body in an upstairs bedroom, lying face-down, the walls, ceiling, and door spattered with blood, and the bloody bat at his feet.His wallet was gone, as was his gold 2015 Ford Fusion."My brother did this. I know it," Matthew Marchalk told police.He said his brother has a drug problem, including heroin addiction, and had been using recently.Michael had been making threats to kill Gary Marchalk and the family, Matthew Marchalk said.Police spoke with Gary Marchalk's wife, Schuylkill County Treasurer Linda Marchalk, who told them she had moved out of the home several weeks ago. Gary Marchalk had filed for divorce on May 11. The couple wed in 2007; Matthew and Michael were born to Gary and his first wife, the late Mary Ann Marchalk.Linda Marchalk told police Michael has had a drug problem for years and had moved in with his father the week before.She had gotten an email from Gary Marchalk on June 16, saying Michael had an appointment at 9 a.m. Monday to enter drug treatment at a Pottsville hospital."Just one more (expletive) issue for me to deal with, but I guess at least I am making some progress, however slight it might be," Gary Marchalk's message said.Linda Marchalk told police there had been "suspicious" activity on the couple's bank accounts on Sunday and Monday.They included a $300 ATM withdrawal at 3:50 a.m. Monday at a Greyhound terminal in Philadelphia.Gary Marchalk's last cellphone voice activity was at 7:55 p.m. Sunday.The only other activity was a text from Matthew Marchalk at 11:21 a.m. Monday.At 7:13 p.m. Saturday, there was a phone call from Gary Marchalk's phone to one registered in Hazleton. Police called it, and the man who answered was uncooperative and hung up.The Marchalks' home security camera showed Michael Marchalk leaving the house in his father's pickup at 7:26 p.m. Sunday.Matthew Marchalk said Michael had called him shortly after 9 p.m. that day from a Hazleton pay phone to tell him he had his father's pickup and was buying drugs.The camera shows Michael Marchalk returning to the house at 10:44 p.m. Sunday.The camera recorded Michael Marchalk backing the Ford Fusion out of the garage, parking it, and going back inside the house.A neighbor's video camera recorded a car leaving the Marchalks' house at 10:52 p.m.The Marchalks' home security cameras show no one else entering the home on Sunday other than Michael Marchalk, and no activity at all after he left.Security video cameras at a Tamaqua gas station showed Michael Marchalk withdrawing money with his father's card and getting gas at 11:22 p.m. Sunday.A video at a bank in New Tripoli recorded him withdrawing money at about 11:30 p.m. Sunday.At 11:40 p.m., security cameras showed him at a supermarket in Fogelsville, where he unsuccessfully tried to withdraw money with another of his father's cards.In the affidavit, Hall noted that Michael Marchalk has numerous retail theft warrants from Westmoreland County.
