Court upholds demolition for Shenandoah homes

(AP) A three-judge Commonwealth Court panel upheld an injunction requiring the owner of a dilapidated building in Shenandoah to demolish it immediately.

Rats, skunks and snakes infest the building at West Coal and Race streets, which also is filled with raw sewage, making it an appropriate subject for demolition. Judge Joseph M. Cosgrove wrote in the panel's 14-page opinion. "The record is replete with evidence to support demolition of the structures on the Race Street property," Cosgrove wrote.By so ruling, the panel affirmed Schuylkill County Judge Charles M. Miller's injunction, filed March 4, 2016, that requires Carlos M. Cruz of Hazleton, to take down three row homes on the property, which he bought in May 2015 knowing that it had been declared a nuisance.Shenandoah filed the lawsuit against Cruz on Dec. 11, 2015, under two state laws - the Neighborhood Blight Reclamation and Revitalization Act and the Borough Code.
