State prison for trespassing, flight charge

A Lehighton man was sentenced to a state prison term Friday afternoon in Carbon County court.

Troy Michael Fairchild, 44, was sentenced by Judge Steven R. Serfass to serve a total of eight to 36 months in a state correctional institution on charges of criminal trespass, a felony two, and flight to avoid apprehension, a misdemeanor two. He previously pleaded to the charges.The trespass incident occurred on Sept. 25, 2016, at a residence along South Street in Lehighton. Fairchild had been doing work at the residence and was staying there while doing the work. He was then told to stop working and was no longer allowed to stay at the property. He was found there by police and arrested after being warned to stay away.The flight to avoid apprehension charged stemmed from an incident on Sept. 23, 2016. He was in a vehicle stopped by police who had a warrant for his arrest out of Schuylkill County. He fledthrough various yards in the area. He later turned himself in to police.In imposing the state term, Serfass noted Fairchild's extensive prior criminal record and said the court didn't feel that the defendant was "amenable" to county supervision. He said despite the plea agreement stating the district attorney's office was not opposed to a county sentence, that was not binding on the court.In addition to the prison term Serfass ordered Fairchild to get both drug and alcohol and mental health evaluations and follow all recommendations for treatment, zero tolerance for drug and alcohol use, supply a DNA sample, pay court costs of about $1,000 and make restitution of $1,690.He was given credit for 157 days already spent in jail on the charges.
