Carbon man gets prison for drugs, endangerment

A Carbon County man was sentenced to a county prison term on Friday morning after previously pleading guilty in three pending criminal cases.

Chad Michael Derr, 40, of Palmerton, was sentenced to serve a total of one day less 12 to one day less 24 months in prison on charges of possession with intent to deliver a controlled substance, endangering the welfare of children and driving under the influence. The jail term will be followed by 24 months of probation.He was charged with the drug count for an incident on May 7, 2016, in the area of 939 Mauch Chunk Road by Palmerton police. He sold heroin to a confidential informant. He was originally charged with 13 drug counts.The endangering count occurred on July 3, 2016, in the 400 block of Alley G. Borough police found Derr's wife in the area with their daughter. When asked by police what she was doing in the area, she said she was waiting for her husband.Derr then left a residence and when confronted by police, he was found to have four plastic bags of crystal methamphetamine on him, which led to the endangering count because he had the drugs with his daughter present.The DUI occurred on Aug. 30, 2014, along Mauch Chunk Street.Mahoning Township police filed the charge. A test showed 0.10 BAC.Derr told the court, "I like to make it clear, I fully accept my responsibility and the punishment."He read a statement to the court in which he said he is addressing his addiction problems and is getting counseling. He said he has the support of his family and has sponsors to "keep me on the road to recovery."Defense Attorney Gregory Lee Mousseau said Derr's drug and alcohol evaluation recommends intensive outpatient treatment.Serfass said he believes that Derr is taking the necessary steps to address his problems.In addition to the prison term, Serfass ordered Derr to get a drug and alcohol evaluation, supply a DNA sample, zero tolerance for drug and alcohol use, pay court costs of about $1,000, render a total of 200 hours of community service when paroled and pay a $50 per month supervision fee while on parole and probation.He was given credit for 198 days already spent in jail on the charges.Following the sentencing proceeding Serfass conducted a probation violation hearing on a petition filed by the adult probation office. Derr was on probation when he was charged with the drug offense.Derr admitted to the violation and was sentenced to serve seven months in prison with the effective date being Aug. 15, 2016. His maximum release date is March 29, 2018.
