Man gets time-served on drug charge

A Carbon County man was given a time-served sentence on Monday in the county court on a drug-dealing charge and told it was his last chance to straightened out his life.

Judge Joseph J. Matkika sentenced Joshua Romanishan, 38, of Mahoning Township, to time-served (231 days) to one day less 24 months in prison on a charge of criminal use of a communication facility.Romanishan and Erik Boehm, 37, of Palmerton, were both charged with felony counts of delivery of a controlled substance, conspiracy - delivery of a controlled substance, possession with intent to manufacture or deliver, criminal use of a communication facility, unlawful possession of a controlled substance, and misdemeanor counts of possession of drug paraphernalia as the result of an arrest in Mahoning Township.Township police conducted a Carbon County Drug Task Force investigation in the parking lot of Walmart on Aug. 9, 2016, where they seized four grams of methamphetamine, hypodermic syringes and a digital scale from Romanishan and Boehm.All the other counts against Romanishan were dropped in a plea bargain with the district attorney's office.Romanishan told Matika, "I've made a lot of mistakes in the past. This is really the hardest it has been in my life."Romanishan said he determined to turn his life around because he now has a wife and family.Matika told him, "This may be your last chance to be a productive citizen." Matika told the defendant with his prior record, any type of criminal conviction in the future will mean a prison term, and probably in the state system.Matika said his sentence was Romanishan's last chance to stay out of the state system.In addition to the prison term Matika ordered Romanishan to get a drug and alcohol evaluation and follow all recommendations for treatment, zero tolerance for drug and alcohol use, supply a DNA sample, render 75 hours of community service when released, pay court costs of about $1,000, pay a $50 per month supervision fee while on parole and must cooperated with the prosecution of his co-defendant, Boehm.Romanishan will not be released from custody despite the time-served sentence. It was noted Montgomery County has a detainer on him for a parole violation.Boehm is scheduled to go on trial on the charges in June. Boehm also has a driving under the influence case pending filed by Franklin Township police.
