Thorpe man pleads to sexual assault of three children

A Jim Thorpe man admitted in Carbon County court on Tuesday that he sexually assaulted three children last year in the borough.

Jared Andrew Novy, 36, pleaded guilty in three pending cases of one count of aggravated indecent assault on a person less than 13, and two counts of indecent assault on a person less than 13.Borough police charged Novy with having sexual contact with three children, two girls ages 7 and 10, and one male, age 4. In all he was charged with a total of 22 counts — 16 counts for the case involving the 7-year-old, and three counts each for the other two victims. The charges included rape, involuntary deviate sexual intercourse with a child, aggravated indecent assault, indecent assault and endangering the welfare of a child.According to the criminal complaints, borough police received a report from Childline on Dec. 3, 2016, indicating possible sexual assault of a child.Through forensic interviews Dec. 14, 2016, the children said Novy had shown the 7- and 4-year-olds pornographic videos and had touched the little girl. The children said they had showered with him, and the boy had witnessed the encounter between Novy and the girl. These incidents occurred in December 2016.The incident with the 10-year-old girl occurred in March 2016 in the borough. In that case he made sexual contact with the girl.Detective Lee Marzen filed the charges.The pleas almost weren’t accepted by Judge Joseph J. Matika. After Assistant District Attorney Brian Gazo read into the record the disturbing allegations of what occurred, Novy was asked if the facts as stated by the ADA were true.He replied, “Some, not all of them.”At that point Matika said he could not accept the pleas if Novy did not admit to the facts as stated by Gazo.Gazo then interjected that if the defendant didn’t want to admit to the facts, then he would withdraw the plea agreement and Novy would go on trial on all pending charges.After a brief conference with his court-appointed lawyer, Hollianne Crystal Snyder of the public defender’s office, Novy said the facts as stated by Gazo were correct.As part of the plea agreement, all the other pending charges will be dropped. Also, the plea calls for a minimum state prison term of four years be imposed.Matika, however, told Novy that he was not a party to the plea bargain and that he can impose any sentence he feels is appropriate. Matika also noted the maximum term for the charges he pleaded to is 10 years.Sentencing was deferred because the charges fall under the provisions of Megan’s Law. Novy will be evaluated by the state sexual offenders assessment board, which will determine if he is a violent sexual predator.If it is determined that he is, then he will have to register for life as a sexual offender. If not, the registration period will be either 15 or 25 years.Matika also ordered the adult probation office to prepare a presentence investigation report.
