Carbon County court - DUI

A Lehigh County resident is facing a year in jail after pleading guilty in Carbon County court on Tuesday to two driving under the influence charges.

He was one of six defendants in pending DUI cases to enter a guilty plea before Judge Joseph J. Matika.Andrew Sean Dougherty, 30, of Allentown, also pleaded to one count of possession of a controlled substance in one of the DUI cases.He was arrested on Jan. 23, 2016, by Nesquehoning police along Stock Street. The second arrest occurred on Nov. 25, 2016, along Maury Road in Penn Forest Township filed by state police at Lehighton.In that case marijuana was found in the vehicle which led to the drug count.In both cases Dougherty refused to submit to testing.Matika told Dougherty that he faces a mandatory minimum of one year in jail on both counts.He said the terms could run concurrent or consecutive to each other, a decision the court will make at the time of sentencing.Sentencing was deferred so Dougherty can obtain drug and alcohol evaluations.Christopher Michael Barachie, 35, of Tamaqua, was arrested on Aug. 13, 2016, by Summit Hill police along Market Street. He refused a blood test.Matika sentenced him to serve five days to six months in jail, a fine of $300, one-year license suspension, zero tolerance for drug and alcohol use and render 25 hours of community service.He will begin the jail term at 10 a.m. Feb. 20.Chad Michael Eschbach, 36, of Lansford, was arrested on April 6, 2016, along Blakeslee Boulevard Drive East by Mahoning Township police.A test revealed the presence of a controlled substance.Sentencing was deferred so Eschbach can apply for placement in the county's Intermediate Punishment Program - house arrest.Gerald Anthony Strouse, 43, of Albrightsville, was arrested on July 9, 2016, along Route 534 by Kidder Township police. A test revealed a 0.22 BAC.A first offense, Matika placed him on probation for six months and ordered he pay a fine of $300, zero tolerance for drug and alcohol use and render 25 hours of community service.Gina Marie McGinley, 50, of Tamaqua, was arrested on July 13, 2016, along Route 902 by Summit Hill police. She refused a blood test.Matika deferred sentencing so she can obtain a drug and alcohol evaluation and apply for the IPP.Joseph Michael Sgrignioli, 46, of Palmyra, Lebanon County, was arrested on July 30, 2016, along Lake Harmony Drive in Kidder Township by state police at Fern Ridge. A test revealed a 0.17 BAC.Sentencing was deferred so Sgrignioli can obtain a comprehensive drug and alcohol evaluation.Each defendant sentenced must also follow all recommendations of their drug and alcohol evaluation, pay court costs of about $1,000 and a $50 per month supervision fee.
