Carbon County court - guilty pleas

A Lansford man admitted on Monday in Carbon County court to assaulting his then sister-in-law during a domestic dispute.

He was one of five defendants in pending criminal cases to enter a guilty plea before Judge Steven R. Serfass.Lansford incidentGeorge Mitzen, 52, pleaded to one count of simple assault. In exchange for the plea a charge of aggravated assault was dropped.Mitzen was arrested on May 22 when Lansford police were dispatched to the 300 block ofWest Patterson Street for a reported domestic dispute. On scene officers learned that Mitzen, who admitted to being under the influence of alcohol at the time, had assaulted his then sister-in-law during a dispute. He said the woman and his brother were having a dispute because their marriage was breaking up and he intervened. He admitted he should not have gotten involved but said his "emotions" got the best of him. He also called the victim his ex-relative. Mitzen also said he entered an inpatient program for 18 days and is continuing counseling for alcohol use.Serfass sentenced him to serve 18 days to one day less 24 months in prison and ordered he render 100 hours of community service, have no contact with the victim and continue his counseling. He was given credit for the 18 days spent inpatient and paroled.Assaults wifeJames Clayton Silvers, 38, of Slatington, pleaded to one count of simple assault.He was arrested on Sept. 7 when Palmerton police were dispatched tothe 1000 block of Mauch Chunk Road, for a domestic assault. On scene officers learned that Silvers had punched his wife under the left eye during an argument.Serfass told Silvers, because of his prior criminal record, he faces a prison term at the minimum range of three to 12 months in prison at the time of sentencing.Serfass deferred sentencing and ordered the adult probation office to prepare a presentence investigation report and also to allow Silvers to apply for placement in the county's Intermediate Punishment Program - house arrest.Resisting arrestTwo defendants entered pleas to resisting arrest and other counts.Brian Robert Vitols Jr.,22, of Levittown, Bucks County, pleaded to one count each of resisting arrest, persistent disorderly conduct and a summary charge of public drunkenness.He was arrested on Sept. 20 when Jim Thorpe police were called to the Union Publick House, 212 Center St., for an unruly person. On scene officers found Vitols under the influence of alcohol. He refused to follow police instructions to leave the area. When told he was under arrest he attempted to flee and struggled with officers.On the resisting charge Serfass sentenced him to time served (12 days) to one day less 24 months; on the conduct count, one year probation consecutive to the first charge; and on the summary a fine of $300.He was also ordered to get a drug and alcohol evaluation, zero tolerance for drug and alcohol use, and render a total of 150 hours of community service.Nathan Thomas Brewster,20, of Lansford, and formerly of Jim Thorpe, pleaded guilty in two pending cases.On the first case he pleaded to resisting arrest for an incident on July 6 along Hazard Square by Jim Thorpe police. He previously failed to appear for a court hearing and officers were attempting to take him into custody when he resisted arrest. He also pleaded to one count of possession of drug paraphernalia for an incident on April 16 filed by Mahoning Township police. He was found walking along Pine Hollow Drive. When confronted by police he was found to have drug paraphernalia on him.Service placed him on probation for 18 months on the resisting charge and one year on the drug count, with the terms running consecutively. He was also ordered to get a drug and alcohol evaluation and render a total of 125 hours of community service.Trespass countCarl Edward Grega,54, of Lehighton, pleaded to one count each of criminal trespass and theft. Grega is currently an inmate in the county prison on the charges.He was arrested by state police at Lehighton for entering the property at 40 Hidden Lane in Towamensing Township and removing items.On the trespass count Serfass sentenced him to time served (64 days) to one day less 24 months; and one year probation on the theft charge, with the terms running consecutively.He was also ordered to supply a DNA sample.His parole will be delayed until the probation office conducts a preparole investigation to determine where Grega is going to live upon his release, and if it is an acceptable location.
