Carbon County court - DUI

A total of nine defendants entered guilty pleas of Tuesday in Carbon County court to driving under the influence and related charges.

President Judge Roger N. Nanovic II accepted the pleas from the following:Steven Russell Montgomery II, 27, of Lansford, pleaded to two counts of DUI in two cases.He was arrested on the first count on May 11, 2014, along Route 209 at Route 248 in Franklin Township by state police at Lehighton. The second arrest occurred on Nov. 27, 2015, along Route 903 in Penn Forest Township by state police at Fern Ridge. In both arrests a test revealed the presence of a controlled substance.Sentencing was deferred so Montgomery could obtain a drug and alcohol evaluation.Keith Silverthorn, 44, of Palmerton, was arrested on June 19, 2015, along Lafayette Avenue by Palmerton police. A test showed 0.20 BAC.Nanovic sentenced to served 173 days to one day less 24 months with credit for 173 days spent in an inpatient rehabilitation program. He was ordered to pay a fine of $2,500 and his license was suspended for a year.Christopher James Fusco, 20, of Brockton, Massachusetts, was arrested on May 8, 2015, along Maury Road in Franklin Township by state police at Lehighton. A test showed the presence of a controlled substance.Sentencing was deferred so he could obtain a D&A evaluation.Pablo Alberto Sosa, 24, of Weissport, was arrested on Jan. 1 along Bridge Street by Lehighton police. A test showed 0.12 BAC.He was sentenced to serve five days to six months in jail, a fine of $750, and a one-year license suspension. On a summary offense of driving under suspension he was fined $200 and costs.He will serve the prison term on consecutive weekends beginning July 26 at 9 a.m., two days, and Aug. 1 at 9 a.m., three days.Shawn Vincent Sitarchyk, 41, of Jim Thorpe, was arrested on Jan. 2 along State Road in Franklin Township by state police at Lehighton. A test showed the presence of a controlled substance.He also entered a plea to receiving stolen property for an incident on Oct. 30, 2015, filed by Lehighton police. He admitted stealing four hub caps from a vehiclein the parking lot of the Gnaden Huetten Memorial Hospital in Lehighton.The victim is an employee at the hospital. The hub caps were returned.On the receiving charge Nanovic sentenced him to serve one to 18 months in prison and on the DUI count 72 hours to one day less six months with the terms running consecutively. On the DUI charge he was ordered to pay a fine of $1,000, one-year license suspension, and get a drug and alcohol evaluation.He was given credit for 37 days spent in prison of the charges. He will serve the remaining time on consecutive weekends beginning at 6 p.m. July 22.Jonathan H. Burak, 41, of Jim Thorpe, was arrested on Jan. 9 along Route 209 in Mahoning Township by state police at Lehighton. A test showed the presence of a controlled substance.Sentencing was deferred so Burak could obtain a comprehensive drug and alcohol evaluation.Philip L. Myers, 44, of Andreas, was arrested on June 24, 2015, along Mahoning Drive in Mahoning Township by state police at Lehighton. A test showed 0.16 BAC.Sentencing was deferred.James Anthony Capelle, 62, of Saylorsburg, was arrested on Dec. 15, 2015, along Interchange Road (Route 209) in Towamensing Township by state police at Lehighton. A test showed the presence of a controlled substance.Nanovic sentenced him to serve 72 hours to six months in prison, a fine of $1,000, and one-year license suspension.Jennifer Gongora, 31, of Kunkletown, was arrested on April 17 along Delaware Avenue by Palmerton police. She pleaded to driving under suspension-DUI related.Nanovic sentenced her to serve 90 days in jail and a fine of $500. The term runs concurrent with a prison term she is currently serving for a parole violation which runs to Oct. 20.Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
