CARBON DUI Guilty Pleas

A total of seven defendants entered guilty pleas in Carbon County court on Monday to driving under the influence and related charges.

President Judge Roger N. Nanovic II accepted the pleas from the following:Marissa Nicole Fethiere,23, of Lehighton, was arrested on Sept. 5, 2015, along Route 248 in Franklin Township by state police at Lehighton. A test showed the presence of a controlled substance.Fethiere told the court she spent 28 days in an inpatient rehabilitation program. She also recently completed serving a 90-day jail term for a probation violation. She had a "hot" urine test for illegal substances.Nanovic sentenced her to serve 72 hours to six months in jail, a fine of $1,500, license suspended for a year, and zero tolerance for drug and alcohol use.She began her jail term Friday morning.Dennis Robert Moyer,46, of Weissport, was arrested on July 2, 2015, along Railway Street in Weissport. A test showed a 0.20 BAC.A first offense, he was placed on probation for six months and ordered to pay a fine of $300.Curtis Lee Stauffer,50, of Kunkletown, was arrested on June 23, 2015, along Route 209 in Franklin Township by state police at Lehighton. A test showed a 0.14 BAC.He was placed on probation for six months and ordered to pay a fine of $300.Richard Stanley Capone,48, of Stroudsburg was arrested on July 28, 2015, by rangers at Beltzville State Park in Towamensing Township. A test showed 0.09 BAC. He also pleaded to driving under suspension-DUI related. He is currently in the Monroe County prison serving a prison term for another DUI.Sentencing was deferred so he could obtain a drug and alcohol evaluation.Michael Steven Cardone,29, of Lehighton, was arrested on Sept. 9, 2015, along Route 209 in Franklin Township by state police at Lehighton. A blood test showed the presence of a controlled substance. He also pleaded to driving under suspension-DUI related.Sentencing was deferred so he could apply for placement in the state's Intermediate Punishment program. He will be transferred to a state prison for the evaluation.Richard M. Miller,49, of Palmerton, was arrested on Jan. 19 along Delaware Avenue by Palmerton police. A test showed 0.18 BAC.Nanovic placed him on probation for 6 months and ordered he pay a fine of $300.Gregory Calvin Neff,46, of Lehighton, was arrested on July 24, 2015, along Route 248 in Palmerton by state police at Lehighton. A blood test showed the presence of a controlled substance.Nanovic sentenced him to serve 72 hours to six months in jail, a fine of $1,000 and license suspended for a year.He will begin the jail term at 7 p.m. on May 27.Each defendant sentenced must also pay court costs of about $1,000 and pay a $50 per month supervision fee while on probation or parole.
