Carbon County court - Drug cases

A Carbon County woman admitted on Tuesday in the county court to her part in drug-dealing in Weatherly and was sentenced to a county prison term.

She was one of nine defendants in pending drug-related cases to enter a plea before Judge Joseph J. Matika.Sale to CIDakota Syphya Klynowsky, 20, of Weatherly, pleaded to one count each of possession with intent to deliver a controlled substance and driving under the influence.She was arrested on the drug charge on Aug. 17 after she and Brett Scott, 25, of Weatherly, sold heroin to a confidential informant working for the borough police. After the sale was made police stopped the vehicle the two were in and found that she was driving under the influence of a controlled substance.Scott was scheduled to plea, but his case was continued.Klynowsky told Matika, "I know I did wrong."She added she was taking what drug classes are available at the county prison.On the possession count Matika sentenced her to serve six to 12 months in prison and ordered her to get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance imposed for D&A use, supply a DNA sample and when released on parole render 50 hours of community service. She was given credit for 95 days already spent in prison on the charge.On the DUI count, Matika sentenced her to serve 72 hours to six months in jail, pay a fine of $1,000, have her license suspended for a year and render 25 hours of community service. The sentence is consecutive to the drug term.Other pleasOther defendants pleading in drug-related cases included:Dana Marie McFadden, 23, of Summit Hill, pleaded to one count of contraband into the prison-drugs. She was arrested on Feb. 24 by Nesquehoning police, who were called to the county prison by prison personnel who found several of the female inmates had been given illegal substances. She was one of the inmates.Matika deferred sentencing and ordered a presentence investigation report be prepared by the adult probation office.Bryan James Baker, 29, of Weatherly, pleaded to one count of possession of drug paraphernalia. He was arrested on Aug. 17 along Carbon Street by Weatherly police following a traffic stop. Baker was a passenger in the vehicle.The arrest was part of an ongoing investigation, police noted. A charge of possession of a controlled substance was dropped in a plea agreement.Matika sentenced him to time-served (40 days) to one year in jail, and ordered he get a D&A evaluation, zero tolerance for D&A use and render 50 hours of community service.Justine Louise Simon, 40, of Nesquehoning, pleaded in two separate cases to two counts of possession of drug paraphernalia. She was arrested on May 14 and July 21, both in the area of 205 Yard St., by Nesquehoning police. One response was for a report of an overdose involving Simon.Simon told Matika she did 25 days in an inpatient rehab program and continues counseling.Matika placed her on probation for a year on each count, running concurrently, and ordered her to get a D&A evaluation, zero tolerance for D&A use, and render 50 hours of community service.Jason David Mumie, 31, of West Hazleton, pleaded to one count of possession of drug paraphernalia. He was arrested on June 7 by Beaver Meadows police following a traffic stop along Berwick Street.Matika placed him on probation for a year and ordered he get a D&A evaluation, zero tolerance for D&A use and render 50 hours of community service.Patrick Matthew Partington, 28, of New Tripoli, pleaded to one count of possession of drug paraphernalia. He was arrested on March 3 by Mahoning Township police in a parking lot of the Carbon Plaza Mall. Police responded to the area for a report of two suspicious people in the lot. On scene Partington was found to be one of those people. He is currently in the Lehigh County prison facing other charges.Matika sentenced him to time served (78 days) to one year in jail, and ordered he get a D&A evaluation, zero tolerance for D&A use and render 50 hours of community service when released from prison.Patrick Colin Neville, 39, of Scranton, pleaded to one count of possession of a controlled substance-heroin. He was arrested on Sept. 1, 2014, by Kidder Township police following an incident in the parking lot of the Wawa store along Route 940.He is currently in the Lackawanna County prison awaiting probation violation proceedings and is facing other parole/probation proceedings in at least two other counties.Matika sentenced him to serve three to 12 months in prison and ordered he get a D&A evaluation, zero tolerance for D&A use and render 50 hours of community service.John Peter Bobita, 56, of Nesquehoning, pleaded to one count of possession of a controlled substance. He was arrested by Nesquehoning police for having oxycodone in is possession while being placed in the county prison on Feb. 25.Matika placed him on probation for a year and ordered he get a D&A evaluation and render 50 hours of community service.Abiel Ben-Daniel Harry, 37, of Brooklyn, New York, pleaded to one count of possession of drug paraphernalia. He was arrested on June 20 by state police at Fern Ridge following a vehicle stop along Interstate 80 in Kidder Township.He was placed on probation for a year and ordered to render 50 hours of community service.David Dejesus Baker, 36, of Milton, Northumberland County, pleaded to one count of possession of drug paraphernalia. He was arrested following a vehicle stop for speeding along Interstate 80 in Kidder Township by state police at Fern Ridge.Matika placed him on probation for a year and ordered he render 50 hours of community service.All defendants sentenced must also pay court costs of about $1,000, and a $50 per month supervision fee while on probation or parole.
