Carbon County court - ARD

Twelve first-time offenders in the criminal justice system were placed in Carbon County's Accelerated Rehabilitation Disposition probation program recently by Judge Joseph J. Matika.

If a person successfully completes all conditions of the program their record will be wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.All were placed for a year, unless otherwise noted.Nicholas Loren Bittner, 20, of Weatherly, was placed on a charge of possession of marijuana. He was arrested on March 23 by Weatherly police in the area of Eurana Park.He was assessed $450 for the cost of the program and ordered to get a drug and alcohol evaluation and follow any recommendations for treatment, zero tolerance imposed on D&A use, and render 50 hours of community service.Shana Lace Clark, 24, of Pocono Summit, was placed on a charge of driving under the influence. She was arrested on April 1 along Interstate 80 in Kidder Township by state police at Fern Ridge. A test showed 0.14 BAC.She was assessed $500 and ordered to render 50 hours of community service and her license suspended for 30 days.Joyce M. Dietrich, 52, of Weatherly, was placed on a DUI charge. She was arrested on Feb. 11 along West Main Street by Weatherly police. A test showed 0.21 BAC.She was assessed $550 and ordered to render 50 hours of community service and license suspended for 60 days.Cynthia D. Gocek, 55, of Weatherly, was placed on a DUI charge. She was arrested on Oct. 25, 2014, along East Main Street by Weatherly police. She refused a blood test.She was assessed $600, ordered to render 50 hours of community service and her license suspended for 60 days.Julie Dunn Harris, 49, of Lehighton, was placed on a DUI charge. She was arrested on March 1 along Blakeslee Boulevard by Mahoning Township police. A test showed 0.19 BAC.She was assessed $550 and ordered to render 50 hours of community service and license suspended for 60 days.Jacqueline Brooke Heydt, 24, of Albrightsville, was placed on a charge of retail theft. She was arrested on March 20 by Mahoning Township police at the Walmart store.She was assessed $650 and ordered to render 50 hours of community service and stay out of the store. The merchandise was recovered.Thomas Joyce Hobin, 19, of Quincy, Massachusetts, was placed on a charge of possession of a small amount of marijuana. He was arrested on March 27 following a vehicle stop along Interstate 80 in Kidder Township by state police at Fern Ridge.He was assessed $450 and ordered to get a drug and alcohol evaluation and render 50 hours of community service.Willard Jeff Nace, 60, of Lansford, was placed on a DUI charge. He was arrested on Feb. 13 along Ridge Street by Lansford police. A test showed 0.22 BAC.He was assessed $600, ordered to render 50 hours of community service and his license suspended for 60 days.Christopher Thomas Porambo, 30, of Summit Hill, was placed on a DUI charge. He was arrested on Feb. 14 along Blakeslee Boulevard by Mahoning Township police. A test showed 0.23 BAC.He was assessed $550 and ordered to render 50 hours of community service and license suspended for 60 days.Tatiana Lee Rodriguez, 19, of Slatington, was placed for six months on a charge of possession of marijuana. She was arrested on May 23 along Route 443 by Mahoning Township police.She was assessed $450 and ordered to render 25 hours of community service.Joseph Bernard Smith, 21, of Scranton, formerly of Coaldale, was placed for six months on a charge of simple assault. He was arrested on June 30 by Lansford police for an incident involving Leann Labenburg as the victim.He was assessed $450 and ordered to get a mental health evaluation, render 25 hours of community service and have no contact with the victim.Justin Brandon Wilson, 30, of Eastpointe, Michigan, was placed on a DUI charge. He was arrested on March 22 by state police at Lehighton along Route 443 in Mahoning Township. A test showed the presence of a controlled substance.He was assessed $600 and ordered to render 50 hours of community service.Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while in the program.
