A Palmerton man, who was sentenced to a state prison term on Tuesday in Carbon County court, was sentenced to another state term on Thursday after pleading to another theft count.
John Joseph Vacaro III, 36, pleaded to one count of theft before Judge Steven R. Serfass. He admitted to removing items from the residence of Shawn Capwell, 404 Fourth St., Palmerton, including a guitar and PlayStation. The incident occurred on July 17, 2014.On Tuesday Vacaro was sentenced by President Judge Roger N. Nanovic II to serve 15 to 38 months in a state correctional institution for the theft of copper wiring in Palmerton. Vacaro was given credit for time spent in multiple inpatient drug rehabilitation programs which amount to about eight and a half months.Thursday Serfass sentenced Vacaro to serve 12 to 36 months in a state prison but ordered it run concurrent with the term imposed by Nanovic. The net result is that, with the credit given for the inpatient program in the first case, and the new sentence, Vacaro will have to serve about an additional five months in prison.He was also ordered to make restitution of $70, pay court costs of about $1,000, pay a $50 per month supervision fee when released on parole, render 150 hours of community service when released on parole, and zero tolerance imposed on drug and alcohol use.
