A Schuylkill County driver was sentenced to a prison term, and a hefty fine, after pleading guilty to driving under the influence.
Robert Lee Zellner, 41, of Andreas, was sentenced by Carbon County President Judge Roger N. Nanovic to serve three to six months in prison. He was also ordered to pay a fine of $5,000.Zellner was arrested on Aug. 23, 2014, along Route 443 by Lehighton police after he entered a sobriety checkpoint. He refused a blood test and will lose his license for a year for the refusal.Nanovic noted that Zellner has four prior DUI convictions, but two of them were over 10 years ago and would not count against him in the instant case, meaning for sentencing purposes this is a second offense.Defense attorney Paul J. Levy told Nanovic that Zellner sought counseling after his arrest on the charge and continues counseling sessions.Nanovic also ordered his license suspended for 18 months, continue counseling, pay court costs of about $1,000, and pay a $50 per month supervision fee while on parole.He will begin the jail term at 6 p.m. on Aug. 7. He was granted work release privileges.
