Pleas entered by defendants
Two defendants in pending criminal cases who were scheduled for trial this week in Carbon County court instead entered guilty pleas.
Two others, also scheduled for trial this week, were placed in the county's Accelerated Rehabilitation Disposition probation program for first-time offenders.The pleas and placements were before President Judge Roger N. Nanovic II.Drug countLaurie Ann Maguschak, 51, of Beaver Meadows, pleaded to one count of possession of drug paraphernalia. In exchange for the plea, a charge of possession of a controlled substance was dropped.Maguschak was arrested on March 28, 2013, by Beaver Meadows police along Broad Street following a traffic stop. She was found to have seven packets of heroin in her purse.Maguschak was previously placed on probation for a drug charge, had it revoked for violating conditions, and spent 30 days in jail. She was resentenced to another period of probation.Nanovic placed her on probation for six months and ordered her to get a drug and alcohol evaluation and follow any recommendation for treatment and imposed zero tolerance for D&A use. She must also pay court costs of about $1,000, and a $50 per month supervision fee while on probation.The probation term runs concurrent with the probation she is now on.Fleeing, DUI countsSamuel James Heydt, 37, of Nesquehoning, entered guilty pleas in two pending cases.He pleaded to one count each of fleeing or attempting to elude police and driving under the influence for an incident on July 30, 2014, along Catawissa Street in Nesquehoning.Police attempted to make a traffic stop but Heydt did not immediately pull over. He traveled a further distance and then pulled over. He exited the vehicle and fled on foot but was apprehended.He pleaded to one count each of DUI and driving under suspension for an incident June 13, 2014, along Mermon Avenue in Nesquehoning. Police observed Heydt operating a red scooter that did not have a registration plate. Police attempted to stop Heydt, who sped away and eventually went onto an off-road trail. A witness identified Heydt as the driver. A charge of fleeing and eluding was dropped in a plea bargain.Nanovic deferred sentencing so Heydt can obtain a comprehensive drug and alcohol evaluation. Heydt is currently an inmate in the county prison on the charges.ARD placementsJo Amber Glasoe, 27, of Palmerton, was placed in the ARD program on two pending cases, both involving retail thefts and both occurring at the Walmart store in Mahoning Township.She was arrested for incidents on Nov. 29, 2014, and Jan. 18. The police arrest reports indicate a total of $282.45 in merchandise was taken in the two incidents.She was placed for two years and assessed $450 for the cost of the program. She must also make restitution in an amount to be determined by the adult probation office.Santina Marie Litke, 21, of Nesquehoning, was placed on a charge of theft by unlawful taking.She was arrested by state police at Hazleton for an incident at 105 Lehigh Gorge Drive, in Lehigh Township. She took a wallet, cash and jewelry from a woman at that address.She was placed for two years, assessed $650 and ordered to get both a drug and alcohol and mental health evaluations and follow any recommendations for treatment, zero tolerance imposed on D&A use, and make restitution to the victim in an amount to be determined by the adult probation office.Both defendants must also pay court costs of about $1,000, and a $50 per month supervision fee while in the program.
