Two defendants given prison terms for retail theft charges

Two defendants were sentenced to prison terms on Thursday in Carbon County court for retail thefts one to a state prison and the second to a county term.

The sentences were imposed by Judge Joseph J. Matika.Mahoning incidentsManuel Antonio Rivera-Agosto, 41, of Allentown, was sentenced to a total of 12 to 36 months in a state correctional institution on two counts of retail theft and one count of possession of drug paraphernalia. He previously entered guilty pleas in the cases.Rivera-Agosto was charged by Mahoning Township police for incidents at the Walmart store that occurred on April 14 and 25, 2014, in which televisions were taken. The drug count stems from the April 14 incident.Rivera-Agosto is currently an inmate in the SCI-Waymart. He was previously sentenced to state prison terms by courts in Lehigh, Northampton and Berk counties for similar charges.In all those cases, the sentences were run currently by the presiding court.On Thursday, Matika gave Rivera-Agosto a break by running the Carbon sentence concurrent to the other cases. Rivera-Agosto, who said he is enrolled in a drug program in the state system, is eligible for parole in January 2016.In addition to the jail term, Matika ordered the defendant to get a drug and alcohol evaluation and follow any recommendation for treatment, zero tolerance imposed on D&A use, make restitution of $1,749 to Walmart, supply a DNA sample, and pay court costs of about $1,000.Lansford incidentWilliam Huot, 50, of Lansford, was sentenced to a total of six to 12 months in the county prison on a retail theft charge. He previously pleaded guilty to the charge stemming from an incident at the Family Dollar Store in Lansford. It is his 13th conviction for retial theft. He also pleaded in another case to one count of possession of marijuana.Because of continuing health problems, Matika agreed to a unique schedule for Huot to serve his prison term.Huot will report to the county prison on March 17 at 8 p.m. and serve five consecutive days. He will then be released for two days, and return to the prison to serve five more days. That will continue until is minimum is served. The reason is for Huot to continue to see physicians and receive treatment for his several ailments.He must also get both drug and alcohol and mental health evaluations, zero tolerance for D&A use, pay court costs of about $1,000, pay a $50 per month supervision fee, and supply a DNA sample.
