Man sentenced in girl's abduction

A Carbon County man who abducted his daughter, which triggered an Amber Alert, was sentenced to a prison term in the county court on Monday.

Timothy C. Simcsuk, 27, of Palmerton, was sentenced by President Judge Roger N. Nanovic II to serve one day less 12 to one day less 24 months in the county prison followed by five years of probation. Since he has already served 394 days in jail, he was paroled.Simcsuk previously pleaded guilty to one count of interference with the custody of children, a felony three.Simcsuk was arrested for an incident at 6:10 p.m. on Dec. 14, 2013, when he took his 4-year-old daughter from her grandmother, Lisa Fatzinger, her legal guardian and sole caregiver.Fatzinger told police that she was outside her apartment with the child when Simcsuk suddenly appeared unannounced and began a conversation. Fatzinger said she was concerned by Simcsuk's sudden appearance because she was aware of a warrant for his arrest and prior attempts he made to interfere with the child's custody. The child's mother is Fatzinger's daughter, Emily Fatzinger.Custody of the child was originally granted to Emily Fatzinger on June 11, 2010, by the county court.Scheduled visitation had been granted to Simcsuk, the child's biological father. However, he had fled the state to avoid arrest on a bench warrant issued in Carbon County for a probation violation for DUI.On Oct. 17, Emily Fatzinger granted temporary guardianship of her child to her mother while she was in Northampton County prison on a drug conviction.On Dec. 14, Simcsuk asked to be allowed to play in the snow with the child, and Fatzinger attempted to stall him. She told police she tried to take the child inside by saying that the child needed warmer gloves.Without warning, Simcsuk grabbed the child and ran into and through the building, out the front door, and around to the side where his minivan was parked with the engine running and sliding side door open.Fatzinger chased Simcsuk and caught up to him at the van, where he pushed her to the ground and kicked her in the face. He then threw the child in the van and drove off through the alley.Immediate efforts to locate Simcsuk and the child were unsuccessful, and an Amber Alert was promptly issued.At 10:50 p.m., Simcsuk was located at a Holiday Inn Express just off the Pennsylvania Turnpike in Quakertown, where he was arrested on the bench warrant by state troopers from the Dublin barracks.Simcsuk said he had intended to take the child to Virginia, and that he had considered killing the child and then himself, before ultimately choosing to surrender.In a separate incident, Simcsuk in June 2013 had taken the child and fled to California during a custody dispute.On Monday, Simcsuk told Nanovic he understands what he did was wrong. He said he would pursue visitation rights with his daughter through the court system.In addition to the jail term Nanovic ordered Simcsuk to get both a mental health and drug and alcohol evaluations and follow any recommendations for treatment, have no contact with his daughter unless a court order grants him visitation following proper court hearings, supply and DNA sample, and attempt to secure a General Education Diploma.Although he was paroled, he will not be released until the adult probation office conducts a pre-parole plan investigation concerning where Simcsuk will live when released.
