Philadelphia man sentenced to state prison on drug count

A Philadelphia man was sentenced to a state prison term on Tuesday afternoon in Carbon County on a drug count.

Terrance Bernard Brown, 50, who previously pleaded guilty to one count of possession of a controlled substance-crack cocaine, was sentenced by President Judge Roger N. Nanovic II to serve a total of 15 to 30 months in a state correctional institution.Brown was arrested by agents of the state Attorney General's office for an incident on May 16, 2013. The agents had a confidential informant contact Brown for the purpose of buying crack cocaine. The informant had been aware of Brown dealing drugs in the county.Brown met with the informant in Mahoning Township and sold him 1 ounce of crack cocaine. Immediately after the sale the agents stopped the vehicle Brown was in and took him into custody.Due to a prior criminal record, which Nanovic noted was long and involved other drug sales, sentencing guidelines recommended a state prison term. Nanovic also noted that Brown's last criminal arrest was many years ago, but added a person's prior criminal record "follows them for life."Although Brown got a break when the commonwealth agreed to drop more serious charges, including delivery, he still faced a prison term because of his prior record.Brown told the court he had entered a drug program in Philadelphia several months ago and said he has been battling drug addiction for 20 years.Defense Attorney Joseph V. Sebelin Jr. asked Nanovic to give Brown credit for time spent in the Philadelphia program. However, Assistant District Attorney Gary Dobias said under state guidelines Brown was not entitled to credit for the program because is was not considered a secured program. A secured program is one in which a person must stay at the facility and cannot leave without the permission of the facility staff. Nanovic agreed.Nanovic gave Brown credit for 28 days he spent in prison on the charge after his arrest. Brown must also pay court costs of about $1,000.Brown will begin the jail term at 3 p.m. on Dec. 26.
