A Luzerne County man pleaded guilty on Tuesday in Carbon County court to his third driving under the influence (DUI) charge and was sentenced to a county prison term.

He was one of 10 defendants in pending DUI cases to enter a guilty plea before Judge Joseph J. Matika.Banks incidentDavid Nice, 47, of Jeansville, pleaded guilty for an incident on Aug. 14, 2012. He also pleaded guilty to driving under suspension-DUI related.State police at Hazleton responded to a reported one-vehicle accident along Market Street in Tresckow, Banks Township. Nice was the driver of the vehicle involved and was found to be under the influence. He was taken for a test, which revealed a .21BAC.It was noted that Nice has two prior DUI convictions.Matika sentenced him to serve six to 24 months in the county prison, pay a fine of $500, license suspended for a year, and ordered he render 100 hours of community service when released on parole, get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment, and zero tolerance imposed on D&A use.On the suspension count he was sentenced to serve 90 days in jail and pay a fine of $1,000. The jail terms run concurrently.Nice began the jail term immediately.Stacey Lee Seifert, 35, of Jim Thorpe, was arrested on Feb. 7 along SR903 by Kidder Township police. She also was charged with resisting arrest but that count was dropped in a plea bargain. She refused to submit to a blood test and will lose her license for a year for the refusal.Matika sentenced her to serve 30 days in jail followed by 23 months in the county's Intermediate Punishment Program (IPP), with the first 60 days on electronic monitoring. That time will be followed by three years of regular probation.She was also ordered to pay a fine of $1,500, license suspended for 18 months, render 100 hours of community service, and zero tolerance imposed on D&A use.She begins the jail term on July 11 at 7 p.m. and will serve the 30 days in three-day spans consecutively.Joseph Robert McNelis, 45, of Beaver Meadows, was arrested on Nov. 11, 2012, by Nesquehoning police along SR93. Given a test, the result was .17BAC.Sentencing was deferred so McNelis could apply for placement in the IPP.Thomas Vernon Strohl, 39, of Weatherly, was arrested on March 28 at W. Railroad and School sts., by Nesquehoning police. Given a test, the result was .26BAC.A first offense, Strohl was placed on probation for six months, and ordered to pay a fine of $300, get a D&A evaluation, zero tolerance on D&A use, and render 25 hours of community service.Jeffrey Scott Garner, 51, of Blakeslee, was arrested on April 7 along Interstate 80 in Kidder Township, by state police at Fern Ridge. Given a test, the result was .18BAC.Matika sentenced him to serve five days to six months in jail, a fine of $300, one-year license suspension, get a D&A evaluation, continue outpatient counseling, and render 25 hours of community service.He will begin the jail term on July 19 at 9 a.m. Matika ruled the sentence is consecutive to one Garner is currently serving in Bucks County.William J. Moller, 25, of Burlington, N.J., was arrested on March 1 along the entrance road to Jack Frost Ski Area by Kidder Township police. Given a test, the result was .12BAC.Matika sentenced him to serve 30 days to six months in jail, a fine of $750, one-year license suspension, get a D&A evaluation, zero tolerance on D&A use, and render 25 hours of community service.Matika gave Mellor credit for 30 days spent in a inpatient rehabilitation program and immediately paroled him.Brenda Lee Stempel, 42, of Weatherly, was arrested on March 16 along Lehigh Gorge Road, in Lehigh Township, by state police at Hazleton. Given a test, the result was .20BAC.A first offense, Stempel was placed on probation for six months and ordered to pay a fine of $300, render 25 hours of community service, and zero tolerance on D&A use.Norman Holland, 41, of Coaldale, was arrested on Dec. 22, 2012, along Market Street by Nesquehoning police. Given a test, the result was .13BAC.A first offense, he was placed on probation for six months, and ordered to pay a fine of $300, and render 25 hours of community service.John R. Heine, 48, of Lehighton, was arrested on March 31, 2012, along SR54 by Nesquehoning police. Given a test, the result was .26BAC.Sentencing was deferred as Heine is currently in a Salvation Army rehab program.Todd William Kerschner, 44, of Lehighton, was arrested on March 29, 2010 along Stoney Ridge Road in Lower Towamensing Township by state police at Lehighton. Given a test, the result showed the presence of a controlled substance. Kerschner also pleaded to one count of possession of drug paraphernalia.He was previously placed in the county's Accelerated Rehabilitation Disposition (ARD) probation program but was revoked for violating conditions.On the DUI charge Matika sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension, get a D&A evaluation, and render 25 hours of community service.On the possession count he was placed on probation for six months and render 25 hours of community service, consecutive to the DUI charge.He will begin the jail term at 9 a.m. on July 26.Each defendant sentenced must also pay court costs, which average close to $1,000, and pay a $50 per month supervision fee while on probation or parole.
