A part-time corrections officer and his girlfriend were placed in Carbon County's Accelerated Rehabilitation Disposition (ARD) probation program on charges stemming from a shooting incident in Lehighton.

Anthony Chiliari, 32, and Eleanor Figuccio, 26, both of Lehighton, were charged following an incident early in the morning on Sept. 17, 2012, at an apartment in the borough.Police responded to a reported shooting about 3:41 a.m. Police said in the arrest report that Figuccio entered the apartment of Chiliari and found him holding a Kel-Tec 9mm handgun. He told her to leave but she refused. Police said in the report she attempted to get by Chiliari, who kept pushing her back. It was alleged that Chiliari put the gun to her head.At this point Figuccio kicked Chiliari and grabbed the gun. At some point it went off hitting him in the right thigh.Another woman was in the apartment with Chiliari at the time. Figuiccio had accused Chiliari of having an affair earlier in the evening prior to leaving the apartment.A day after Figuiccio was charged, police filed simple assault count against Chiliari alleging he attempted to put Figuccio in fear of imminent bodily harm.Chiliari was suspended from his part-time job after being arrested.Yesterday President Judge Roger N. Nanovic approved the application for ARD placement for the two which was presented by the district attorney's office.Each were placed for a year and were assessed $650 each for the cost of the program, and must each render 50 hours of community service.A proposal for no contact was withdrawn when attorneys for the two said they were trying to get back together. Nanovic did order that Chiliari and Fuguccio can not harass, abuse, or threaten each other.Both must also pay court costs and a $50 per month supervision fee while in the program. A person does not admit guilt in entering the program.
