Five first time offenders in the criminal justice system were placed in Carbon County's Accelerated Rehabilitation Disposition (ARD) probation program on Thursday by Judge Joseph J. Matika.

If a person successfully completes all conditions of the program their record is wiped clean. However, if they fail to complete it or are revoked from it, they will face trial on all pending charges. A person does not admit guilt in entering the program.All were placed for a year.Alainna Marie Bunch, 33, of Jim Thorpe, was placed on a charge of possession of a prohibited offensive weapon and a drug count. She was arrested on Oct. 14, 2012, by Kidder Township police for an incident in which she had a five-inch knife and brass knuckles in her possession and a some cocaine, police said.She was ordered to get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment, and render 50 hours of community service.Christopher Fabiani, 24, of West Hazleton, was placed on a charge of driving under the influence (DUI). He was arrested on Dec. 23, 2012, along First St., by Weatherly police. Given a test, the result was .18BAC.He was assessed $550 for the cost of the program, and ordered to get a D&A evaluation, zero tolerance on D&A use, render 50 hours of community service, and license suspended for 60 days.Michael Thomas Lucas, 47, of Lehighton, was placed on a DUI charge. He was arrested on July 5, 2012, along Bridge St., in Lehighton, by state police at Lehighton. Given a test, the result was .14BAC.He was assessed $500 for the cost of the program, and ordered to get a D&A evaluation, render 50 hours of community service, and license suspended for 30 days.Kevin R. Maguschak, 33, of Beaver Meadows R.1, was placed on a DUI charge. He was arrested on Nov. 23, 2012, at Broad and Beaver sts., by Beaver Meadows police. Given a test, the result was .21BAC.He was assessed $550, and ordered to get a D&A evaluation, zero tolerance on D&A use, render 50 hours of community service, and license suspended for 60 days.Carole A. Mott, 45, of Clarks Summit, Lackawanna County, was placed on a DUI charge. She was arrested on Dec. 1, 2012, along SR1003 by Kidder Township police. Given a test, the result was .15BAC.She was assessed $500, and ordered to get a D&A evaluation, zero tolerance on D&A use, render 50 hours of community service, and license suspended for 60 days.Each defendanet must also pay court costs, which average close to $1,000, and pay a $50 per month supervision fee while in the program.
