A Carbon County man will be spending some significant time in a state prison after he pleaded guilty on Thursday in the county court to several pending criminal counts.

He was one of 24 defendants to enter a guilty plea before Judge Steven R. Serfass.Escape, DUIKyle Kubin, 29, of Lehighton, pleaded guilty in three pending cases.He pleaded to one count of escape and possession of drug paraphernalia for an incident on Sept. 2, 2012, in Jim Thorpe. Borough police made a vehicle stop in the area of Lehigh St. and Hazard Square in which Kubin was a passenger in the vehicle. He was wanted and attempted to flee but was apprehended. Found on him was drug paraphernalia.He also pleaded to one count of driving under the influence (DUI) and driving while under suspension-DUI related. He was arrested on those counts on Sept. 7, 2012, along White St., in Weissport, by state police at Lehighton. Given a test, the result showed the presence of a controlled substance.He pleaded to a second count of DUI for an incident on Oct. 28, 2012, along Main Rd., in Franklin Township, and filed by state police at Lehighton. A test revealed the presence of a controlled substance.Kubin is currently serving a state prison term for a probation violation which runs to Nov. 21, 2014.On the first DUI count, Serfass sentenced him to serve 12 to 24 months in a state prison, fined $2,500, license suspended for 18 months, ordered to get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment, and render 100 hours of community service when released on parole. On the driving under suspension charge he was sentenced to serve 90 days in jail and pay a fine of $1,000. The jail terms run concurrently.On the second DUI he was sentenced to serve two to 24 months in a state prison, fined $2,500, another 18 months license suspension and render 100 hours of community service. The jail term runs concurrent to the first DUI.On the escape count he was sentenced to serve 12 to 24 months in a state prison and on the possession charge six to 12 months, all terms concurrent. His total new sentence is 12 to 24 months. Serfass ruled, however, the new term runs consecutive to the term he is currently serving in the state system. He was given credit for seven days spent in jail on the charges.Other casesOther defendants who entered pleas included:Gary Donald Marshall, 43, of Grover, N.C., pleaded guilty to one count each of resisting arrest and a summary offense of public drunkenness.He was arrested on Dec. 31, 2012, in the area of the Lehighton Fire Company station along S. Third St. where he was causing a problem. When police attempted to take him into custody, he struggled with officers and had to be subdue.Serfass rejected a request for probation citing Marshall resisting police making a lawful arrest. He sentenced him to serve two to 12 months in the county prison on the resisting charge, and ordered he get a D&A evaluation, zero tolerance imposed on D&A use, render 50 hours of community service when released on parole, and was given credit for 10 days spent in jail on the charge.On the summary offense he was fined $300 and costs. He will begin the jail term at 9 a.m. on March 1.Adam Ceykovsky, 25, of Danielsville, pleaded to one count each of resisting arrest and a summary offense or disorderly conduct.He was arrested on Aug. 9, 2012, in the area of 219 N. First St., by Lehighton police. Police responded to a report of a domestic incident and found Ceykovsky at the scene highly intoxicated.On the resisting charge Serfass sentenced him to time served (68 days) to one day less 24 months in jail, and ordered he get a D&A evaluation, zero tolerance on D&A use, and render 100 hours of community service. On the summary count he was fined $300 and costs.Ceykovsky has a probation violation detainer on him from Northampton County, it was noted.Jennifer Lynn Berry, 42, of Stroudsburg, pleaded to one count of driving under the influence (DUI). She was arrested on July 1, 2012, along Bridge St., by Lehighton police. Given a test, the result was .11BAC.Serfass sentenced her to serve five days to six months in jail, a fine of $300, one year license suspension, get a D&A evaluation, and render 25 hours of community service. She began the jail term immediately.Robert P. Beck Jr., 47, of New Ringgold, pleaded to one count of DUI. He was arrested on May 11, 2012, along Lentz Trail by Jim Thorpe police. Given a test, the result was .11BAC.A first offender, he was placed on probation for six months and ordered to pay a fine of $300, get a D&A evaluation, and render 25 hours of community service.Kevin S. Loar, 42, of Lansford, pleaded to one count of DUI. He was arrested on Aug. 11, 2012, along Beaver Run Road by Mahoning Township police, after being involved in a motorcycle accident. Given a test, the result was .19BAC.Serfass sentenced him to serve 48 hours to six months in jail, a fine of $500, one year license suspension, get a D&A evaluation, and render 25 hours of community service. He begins the jail term at 6 p.m. on March 1.Mark P. Hettler, 35, of Summit Hill, pleaded to one count of resisting arrest. He was arrested for an incident on Nov. 7, 2012, at the probation office at the courthouse in Jim Thorpe. He was at the office for an appointment when he was told his probation was being revoked and he was going to the county prison. He resisted two county probation officers who attempted to take him into custody. He is currently serving a six to 12 months sentence for the probation violation.Serfass sentenced him to serve two to one day less 24 months in prison and render 100 hours of community service. The new jail term runs consecutive to the one Hettler is currently serving.Michael Cardone, 26, of Lehighton, pleaded to one count of DUI. He was arrested on Sept. 27, 2012, along Bankway by Lehighton police. Given a test, the result showed the presence of a controlled substance.Serfass sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, get a D&A evaluation, zero tolerance on D&A use, and render 25 hours of community service. Cardone is currently in the county prison facing a parole violation.Jennifer Coxe, 38, of Weatherly, pleaded guilty to two counts of DUI in two pending cases.She was arrested on March 13, 2010, along North St., by Weatherly police. Given a test, the result was .16BAC. The second arrest occurred on July 22, 2012, by state police at Lehighton along SR209 in Lehighton. Given a test, the result was .12BAC.Sentencing was deferred.Keith Evert, 27, of Lehighton, pleaded to one count of DUI. He was arrested on Oct. 13, 2012, by state police at Lehighton in the Canal Park area of Weissport. Given a test, the result showed the presence of a controlled substance.Serfass sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, get a D&A evaluation, and render 25 hours of community service. He was given credit for two days spent in jail on the charge. He will serve the third day beginning at 5 p.m. on Feb. 15.Mathew Schaffer, 36, of Lehighton, pleaded to one count of DUI. He was arrested on Sept. 18, 2012, along Upper Nis Hollow Drive, by Mahoning Township police. Given a test, the result was .08BAC.Serfass sentenced him to serve 48 hours to six months in jail, a fine of $500, one year license suspension, get a D&A evaluation, zero tolerance on D&A use, and render 25 hours of community service. He will begin the jail term at 10 a.m. on Feb. 22.Walter Whaley, 48, of Lehighton, pleaded to one count of DUI. He was arrested on Oct. 3, 2012, along Center Alley by Lehighton police. Given a test, the result was .21BAC.Serfass sentenced him to serve 30 days to six months in jail, a fine of $300, one year license suspension, get a D&A evaluation, and render 25 hours of community service. He will begin the jail term at 9 a.m. on Feb. 22.Charles E. Cera, 60, of Jim Thorpe, pleaded to one count of DUI and a summary offense of driving under suspension. He was arrested on April 28, 2012, along SR903 by Jim Thorpe police. Given a test, the result was .15BAC.Serfass sentenced him to serve five days to six months in jail, a fined of $300, one year license suspension, get a D&A evaluation, and render 25 hours of community service. He will begin the jail term at 11 a.m. on Feb. 18.On the summary offense he was fined $200 and costs.Robert Joseph Clary, 51, of Jim Thorpe, pleaded to one count of possession of a controlled substance-cocaine. He was arrested on Sept. 26, 2012, by agents of the state Attorney General's office along SR903 in Jim Thorpe.Serfass placed him on probation for a year and ordered he get a D&A evaluation, and render 50 hours of community service.Arthur Scott Hanman, 44, of Jim Thorpe, pleaded to one count of theft. He was arrested by Jim Thorpe police for an incident in which Denise Staubinger is the victim. He took prescribed medication from the victim's residence.Serfass placed him on probation for six months and ordered he get a D&A evaluation, and render 25 hours of community service.Shawn P. Kerr, 25, of Hazleton, pleaded to one count of DUI. He was arrested on Feb. 9, 2011, along Broad St., by Beaver Meadows police. Given a test, the result showed the presence of a controlled substance.Serfass sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, get a D&A evaluation, and render 25 hours of community service. He began the jail term immediately.Patrick A. Walbert, 23, of Lehighton, pleaded to two counts of access device fraud and one count each of criminal attempt-access device fraud, theft, and receiving stolen property.He was arrested by Lehighton police for taking the purse of Rita Nothstein on or about Nov. 30, 2012, and using her credit card(s) at locations in the area and also in the Philadelphia area.Serfass placed him probation for a total of 48 months and ordered he make total restitution of $806.63 to the victim, and render a total of 200 hours of community service during the length of the sentence.Claire Elizabeth Krage, 26, of Scotrun, Monroe County, pleaded to one count of DUI. She was arrested on Oct. 6, 2011, along SR209 in Franklin Township by state police at Lehighton. Given a test, the result was .19BAC.Serfass sentenced her to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, and render 25 hours of community service. She was given credit for 33 days spent in a inpatient rehabilitation program and immediately paroled.Lisa A. Hartpence, 51, of Slatington, pleaded to one count of DUI. She was arrested on June 24, 2012, along Mauch Chunk Rd., in Palmerton, by state police at Lehighton. Given a test, the result was .22BAC.Serfass placed her on probation for six months and ordered she pay a fine of $300, get a D&A evaluation, and render 25 hours of community service.Shawn Patrick Latshaw, 40, of Walnutport, pleaded to one count of driving under suspension-DUI related. He was arrested on Sept. 25, 2012, along Delaware Avenue by Palmerton police.Serfass sentenced him to serve 60 days in jail and pay a fine of $500. He was given credit for 50 days in jail and is currently in the prison. He is facing a probation violation in Lehigh County, it was noted.Matthew Damian Frederick, 19, of Palmerton, pleaded to one count of terroristic threats. He was arrested on Dec. 31, 2012, by Palmerton police for an incident at his residence at 539 Lehigh Ave. Charges of aggravated and simple assault were dropped in a plea agreement.Serfass sentenced him to serve one to one day less 24 months in jail, and render 100 hours of community service. He was given credit for 46 days spent in jail on the charge and was immediately paroled.Cody Robert Queen, 19, of Jim Thorpe, pleaded to one count of DUI. He was arrested on Aug. 16, 2012, along Circle Drive by Franklin Township police. Given a test, the result was .08BAC.Serfass placed him on probation for six months and ordered he pay a fine of $300, get a D&A evaluation, and render 25 hours of community service.David Rowe, 21, of Palmerton, pleaded to one count of simple assault. He was arrested by Palmerton police for an incident in the area of 757 Church St. Police responded to area for a reported assault. Police attempted to placed Rowe under arrest when he struck Office Shawn Leadbetter in the face.Serfass deferred sentencing and ordered the presentence investigation (PSI) be prepared by the adult probation office.Beth Ann Hosier, 28, of Lehighton, pleaded to one count of DUI. She was arrested on Sept. 28, 2012, at a DUI checkpoint operation by Lehighton police. Given a test, the result showed the presence of a controlled substance.Serfass sentenced her to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, get a D&A evaluation, and render 25 hours of community service. She will begin the jail term at 9 a.m. on Feb. 22.All defendants sentenced must also pay court costs, which average close to $1,000, and pay a $50 per month supervision fee while on probation or parole.0
